农村土地承包经营纠纷多元化解决机制论

【摘要】：近年来,随着土地纠纷数量的急剧上升,对土地纠纷多元化解决机制的探讨也愈加激烈。探讨农村土地承包经营纠纷多元化解决机制,不仅迎合国家重视农村土地问题解决的潮流,而且对于农民土地权利的切实保护、农村社会的稳定发展乃至社会主义法治国家目标的实现都具有重大意义。本文从农村土地承包经营纠纷多元化解决机制的概说入手,提出了我国农村土地承包经营纠纷多元化解决机制存在的问题,并且结合实践中村民对土地承包经营纠纷多元化解决机制的选择,针对问题提出了自己的建议。全文共计约31,000字,除引言和结语外,由三部分组成。第一部分,农村土地承包经营纠纷多元化解决机制概说。本部分首先简单介绍了农村土地承包经营纠纷的特点及表现形式,接着列出了农村土地承包经营纠纷多元化解决机制的政策及立法沿革,最后点出探寻农村土地承包经营纠纷多元化解决机制之意义所在。第二部分,我国农村土地承包经营纠纷多元化解决机制的现实分析。本部分首先对我国农村土地承包经营纠纷多元化解决机制的现行立法进行了分析,提出目前我国农村土地承包经营纠纷多元化解决机制所具有的进步之处,同时也分析了其存在的缺陷。接着对农村土地承包经营纠纷多元化解决机制进行了实证分析,通过调研数据展现了村民对于土地承包经营纠纷多元化解决机制的选择。第三部分,完善我国农村土地承包经营纠纷多元化解决机制的建议。虽然国家对于农村土地承包经营纠纷问题给予了充分的重视,并且针对农村土地承包经营纠纷出台了专门的法律。但是,我国农村土地承包经营纠纷多元化解决机制仍然存在一定的不足之处。本部分针对我国农村土地承包经营纠纷多元化解决机制存在的问题,提出了一系列予以完善的建议,如:加强对仲裁委员会的监督、强化调解在解决农村土地承包经营纠纷中的重要作用、强化仲裁与诉讼的合理衔接等,以期对我国农村土地承包经营纠纷多元化解决机制的进一步完善尽自己的绵薄之力。
[Abstract]:In recent years, with the rapid increase in the number of land disputes, the discussion of the diversification of land disputes resolution mechanism is becoming more and more intense. To probe into the diversified settlement mechanism of rural land contract management disputes not only caters to the trend that the state attaches importance to the rural land problem resolution, but also effectively protects the peasants' land rights. The stable development of rural society and the realization of the goal of socialist country ruled by law are of great significance. Based on the summary of the diversified settlement mechanism of the rural land contract management dispute, this paper puts forward the problems existing in the diversification settlement mechanism of the rural land contract management dispute in our country. Combined with the villagers' choice of diversified settlement mechanism of land contract management disputes in practice, the author puts forward his own suggestions for the problems. The full text is about 31000 words, in addition to the introduction and conclusion, consists of three parts. The first part, rural land contract management dispute diversification settlement mechanism. This part briefly introduces the characteristics and forms of disputes in rural land contract management, and then lists the policy and legislative evolution of the diversified settlement mechanism of rural land contract management disputes. Finally, it points out the significance of exploring the diversified settlement mechanism of rural land contract management disputes. The second part, the reality analysis of the diversification settlement mechanism of the rural land contract management dispute in our country. This part first analyzes the current legislation of the dispute resolution mechanism of rural land contract management in China, and puts forward the progress of the diversified settlement mechanism of rural land contract management dispute in our country at present. At the same time, the defects are analyzed. Then the paper makes an empirical analysis on the diversification resolution mechanism of land contract management disputes in rural areas, and shows the villagers' choice of diversification resolution mechanism for land contract management disputes through the investigation data. The third part, consummates our country countryside land contract management dispute diversification solution mechanism suggestion. Although the state has paid enough attention to the dispute of rural land contract management, it has issued a special law for the dispute of rural land contract management. However, there are still some deficiencies in the diversified settlement mechanism of rural land contract management disputes in China. In this part, the author puts forward a series of suggestions, such as strengthening the supervision of the arbitration commission, aiming at the problems existing in the diversified settlement mechanism of the rural land contract management dispute in our country. Strengthening mediation plays an important role in resolving the disputes of rural land contract management and strengthening the reasonable connection between arbitration and litigation in order to further improve the diversified settlement mechanism of rural land contract management disputes in our country.
