【摘要】：规范国家权力和保障公民权利是法学研究的永恒主题,为实现打击犯罪与保护人权的统一,世界各国都授予警察限制与剥夺公民人身自由并对其进行监管的权力,该权力的行使具有一定的特殊性,但仍应合理使用并受到适当的外部监督。封闭是监狱和看守所的顽症,缺少外部监督的国家监管权力,难免侵害被监管人员的合法权利。监所开放正是这样一种与刑事诉讼程序紧密相连而又独立于刑事诉讼程序的制度,它以推进监管场所透明化为目的,致力于为被监管人员权利救济提供一种新的路径。本文在分析我国监所开放现状的基础上,分析并借鉴域外理论和实践,提出构建我国监所开放制度的具体设想。本文由引言、正文和结束语组成,正文共分四个部分: 第一部分,监所开放的概述。通过对“监所”的界定,指明了本文所研究的“监所”的由来和范围;通过对监所开放涵义的阐述,说明监所开放的主体要素是什么,并明确指出监所开放在我国是一种新的制度,这项制度的构建需自身努力探索,也需要借鉴国际规则及域外的做法。第二部分,监所开放的必要性。包括四个方面:履行政府信息公开义务,保障公民知情权;以司法公开促进司法公正,保障被监管人员的人权;对监所进行治理,推进监所法治化进程;通过保障公民权利制约与监督国家监管权力,扩大社会力量对监所的监督。第三部分,我国监所开放现状评析,主要包括我国监所开放取得的成绩和存在的问题。从成绩来看,一方面我国监所开放的相关文件日益完善,另一方面我国监所的实践经验日益丰富;从存在的问题来看,我国监所开放的广度和深度不够;我国监所开放的随意性较大。第四部分,我国监所开放的制度构想。先阐述了监所开放的原则:必须遵循人民主权、依法开放、适度开放、循序渐进的原则;其次阐述了监所开放的主体,即监狱和看守所这两类典型的监管场所;然后阐述了监所开放的范围,包括应当开放的范围和不开放的范围,范围的确定遵循“开放是原则,不开放是例外”;最后论述了监所开放的具体方式,我国监所开放的具体方式应当包括巡视员制度、媒介采访制度、亲属探访制度、公众参观制度。
[Abstract]:To standardize the state power and guarantee civil rights is the eternal theme of law research , in order to realize the unity of fighting crime and protecting human rights , all the countries of the world have the power to limit and supervise the liberty of citizens and supervise them .

This paper consists of introduction , text and conclusion , the text is divided into four parts :

The first part is an overview of the opening of the monitor . Through the definition of the " monitor " , the origin and scope of the " monitor " studied in this paper are pointed out ; through the exposition of the open meaning of the monitor , the main elements of the opening of the monitor are explained , and it is pointed out that the opening of the monitor is a new system in our country , and the construction of the system requires its own efforts to explore , and it also needs to draw lessons from international rules and extraterritorial practices .

The second part , the necessity of the opening of the prison , includes four aspects : fulfilling the public obligation of the government information , guaranteeing the right of citizens to know the right , promoting the judicial fairness by the judicial openness , guaranteeing the human rights of the regulated personnel , and carrying out the governance of the prison , advancing the process of the law of the supervision and supervising the supervision of the supervision by guaranteeing the supervision of the civil rights and supervision of the State , and expanding the supervision of the social forces to the monitor .

In the third part , the assessment of the present situation of the opening of our country ' s prisons mainly includes the achievements and problems of the opening of our country ' s monitor .
