多元化民事调解机制研究

【摘要】：民事调解制度是中华法文化的重要资源,在ADR(Alternative Dispute Resolution)制度蓬勃发展的国际环境和我国构建社会主义和谐社会的时代背景下,中国的调解制度也得到了重新重视,不过它已不同于封建时期和革命时期的调解制度,依法调解,建立融司法调解、行业调解、行政调解和人民调解于一体,有效的、全面的、互相衔接的多元化民事调解机制,对解决中国现实存在的众多纠纷具有重大的理论和现实意义,它关系到构建完善的社会矛盾解决机制,关系到依法治国的治国方略,更关系到建设社会主义和谐社会的宏伟大业。本文结合最新的司法改革成果,运用历史分析的方法研究了调解的历史状况,对各种调解方式的现状和这一制度的利弊做了客观分析,并逐一提出了各种调解方式的问题和解决对策,本文提出要树立正确的调解观念,坚持调解的自愿原则,扬长避短,建立人民调解为基础,法院调解为依托,行政调解为主力,行业调解为补充的多元化民事调解机制。
[Abstract]:Civil mediation system is an important resource of Chinese legal culture. Under the background of the booming international environment of Alternative dispute Resolution system and the construction of socialist harmonious society in our country, China's mediation system has also been revalued. However, it is different from the mediation system of the feudal period and the revolutionary period. It is different from the mediation system of the feudal period and the revolutionary period. It has established a diversified civil mediation mechanism that integrates judicial mediation, trade mediation, administrative mediation and people's mediation, and is effective, comprehensive, and interlinked with each other. It is of great theoretical and practical significance to solve the numerous disputes existing in the reality of China. It is related to the construction of a perfect mechanism for resolving social contradictions and the strategy of governing the country according to law. More related to the construction of a socialist harmonious society of the great cause. Combined with the latest achievements of judicial reform, this paper studies the historical situation of mediation by using the method of historical analysis, and makes an objective analysis of the present situation of various mediation methods and the advantages and disadvantages of this system. And put forward a variety of mediation methods and solutions one by one, this paper proposes to establish a correct mediation concept, adhere to the voluntary principle of mediation, build up the people's mediation as the basis, court mediation as the basis, administrative mediation as the main force. Industry mediation is supplemented by a diversified civil mediation mechanism.
