我国陪审制度的历史及其改革——兼论中外“陪审”之“陪”的语义差别

【摘要】：我国陪审制度之"陪",从清朝末年的引进,发展到如今的人民陪审员制度,其中内含了多重的语义和价值吁求。现行立法中的"人民陪审员",既不是英美法系大众化的"陪审团成员",也不是大陆法系专家化的"参审员"。人民陪审员制度的改革,应当把握人民陪审之"陪"的语义及其折射的伦理价值需求,在达成共识的基础上,平衡和协调民意监督、政治民主和司法借力这"三重价值期望",保证人民陪审员的实质性参与,将现行人民陪审员制度"一分为三":根据不同情况分别实行人民陪审团制度、机册(人民)陪审员制度和专册(人民)陪审员制度,真正实现人民陪审的司法借力和"民主"功能。
[Abstract]:The "accompany" of the jury system in China developed from the introduction of the late Qing Dynasty to the present people's jury system, which contains many semantic and value appeals. The "people's jurors" in the current legislation are neither "jurors" who are popularized in Anglo-American law systems nor "assessors" who are experts in civil law systems. In the reform of the people's jury system, we should grasp the meaning of the "escort" of the people's jury and its reflected ethical value needs, balance and coordinate the supervision of public opinion on the basis of reaching a consensus. The "triple value expectation" of political democracy and judicial power ensures the substantive participation of the people's jurors and "divides the current people's jury system into three": the people's jury system is implemented separately according to different circumstances. The juror system of machine book (people) and the system of special book (people) really realize the function of judicial borrowing and democracy of people's jury.
