法律服务与农村区域经济发展若干问题的研究

【摘要】：盘古开天地，农业是中华数千年文明的根基。在社会主义市场经济日益发展的今天，农业仍然是国民经济的基础。农村区域经济的发展受到各种因素的影响和制约，法律因素对市场经济条件下的农村经济的发展有着重要影响。随着社会主义市场经济的发展，农村地区的法律纠纷日益增多，对法律服务的需求也越来越大。由于各种因素的制约，当前的法律服务并不能满足当前农村地区对法律服务的需求。本文对法律服务和法律服务机构作了新的广义上的理解，并主要通过五个部分对当前农村的法律纠纷对农村经济的影响、农村对法律服务的需求、农村地区法律服务的供给及法律服务现状、造成当前农村地区法律服务现状的原因、如何加强和改进当前农村地区法律服务水平等方面进行了简要分析。本文共分为六章：第一章简述了研究背景、研究目的及意义、国内外研究动态、研究思路与方法、可能创新之处。第二章通过对当前农村地区的主要法律纠纷的类型进行简要分析，并列举当前较有影响的案例的形式分析了当前农村地区的法律纠纷对农村经济发展的影响；第三章通过当前农村对法律咨询人员的需求，对调解人员的需求，对证据保全人员的需求，对鉴定人员的需求，对治安人员的需求，对诉讼代理人员的需求，对司法裁判人员的需求，对法律宣传人员的需求，对法律援助人员的需求等方面分析了当前农村区域经济发展对法律服务的需求；第四章首先通过国家对农村地区法律服务的法律供给、国家对农村地区法律服务的政策供给、国家对农村地区法律服务的制度供给等方面分析了当前农村地区法律服务的供给情况，随后分析了当前农村地区法律服务机构的现状、其他法律机构及有关执法部门服务农村区域经济发展的现状、当前农村地区法律服务人员及其提供的法律服务现状；第五章对造成当前农村地区法律服务现状的原因做了简要分析；第六章对如何加强和改进当前农村地区法律服务水平进行了简要分析，并提出了几项具体措施。 农村的发展问题关系到国民经济的基础，而农村法律服务水平的高低直接影响到农村社会的稳定和经济的发展，因此，，对农村法律服务问题进行研究，对整个国民经济的健康发展有着重要意义。本文不但提出了“法律服务机关”、广义上的“法律服务”和广义上的“法律服务机构”等概念，而且通过对当前农村的法律纠纷对农村经济的影响、农村对法律服务的需求、农村地区法律服务的供给及法律服务现状、造成当前农村地区法律服务现状的原因等问题的分析，针对如何加强和改进当前农村地区法律服务水平提出了有关建议对策，特别是提出了：建议制定区别对待农民和市民的法律服务收费标准；建议制定《农村法律普及法》；消除腐败应该先从政法部门开始；惩治腐败的既往不咎原则；惩治腐败市场的经纪人；建立农村法律事务联络员；加大对基层司法、执法机构的财政扶持，逐步减少并消除公安等司法、执法部门的临时工作人员；努力提高有关法律服务部门首长的业务素质，加强对有关法律服务部门（特别是法律服务机关）首长的业务培训，新提拔或任命的有关法律服务部门（特别是法律服务机关）主要负责人必须是精通业务的法律专业人员等有关措施，以期对提高农村地区的法律服务水平，促进农村地区的经济发展有所裨益。
[Abstract]:The agriculture is the foundation of China's civilization for thousands of years. In today's socialist market economy, agriculture is still the foundation of the national economy. The development of the rural regional economy is influenced and restricted by various factors. The legal factors have an important influence on the development of the rural economy under the conditions of market economy. The development of the market economy, the increasing number of legal disputes in the rural areas, and the increasing demand for legal services. Due to the constraints of various factors, the current legal services can not meet the needs of the current rural areas for legal services. This paper makes a new and broad understanding of the legal services and legal service institutions, and mainly Through five parts of the current rural legal disputes on the rural economy, the demand for legal services in rural areas, the supply of legal services in rural areas and the status of legal services, the causes of the current status of legal services in rural areas, how to strengthen and improve the current legal service level in rural areas have been briefly analyzed. This article is divided into six chapters: the first chapter briefly introduces the research background, the purpose and significance of the research, the research trends at home and abroad, the research ideas and methods, and the possible innovations. The second chapter analyzes the types of the main legal disputes in the current rural areas, and analyzes the current rural areas in the form of the current more influential cases. The third chapter, through the demand of the legal consultants in the countryside, the demand for the mediation personnel, the demand for the evidence preservation personnel, the needs of the appraisers, the demand for the public security personnel, the demand for the litigation agents, the demand for the judicial officials and the legal propaganda personnel. Demand, the demand for legal aid personnel, and other aspects of the needs of the current rural economic development of the legal service; the fourth chapter first through the legal provision of legal services in the rural areas, the state's policy supply of rural areas of legal services, the state of the rural area of the legal service system supply and other aspects of the analysis of the system. The problem of rural development is related to the basis of the national economy, and the level of rural legal service directly affects the stability of the rural society and the economic development. Therefore, it is of great significance to study the problem of rural legal service to the healthy development of the whole national economy. This paper not only puts forward the "legal service organ", but also has a broad sense. This paper puts forward some suggestions on how to strengthen and improve the current legal service level in rural areas, especially put forward: recommending the formulation of the legal service charge standard that distinguishes the peasants and the citizens, and recommends the formulation of the law of popularization of rural law; the elimination of corruption should begin with the political and law departments first; and punish the principle of the past no blame for corruption; To punish the broker in the corrupt market, to establish liaison officers in legal affairs in rural areas, to increase financial support for grass-roots judicial and law enforcement agencies, to gradually reduce and eliminate public security and other judicial and temporary workers in law enforcement departments, to improve the business quality of the head of the legal service department and to strengthen the relevant legal service departments (especially the law). The business training of the head of the service, the new promotion or appointment of the relevant legal service departments (especially the legal service organs) must be the relevant legal professionals who are proficient in business, with a view to improving the legal service level in rural areas and promoting the economic development of rural areas.
