监狱管理创新若干问题研究

【摘要】:社会矛盾化解、社会管理创新和公正廉洁执法,是当前我国政法机关的三项重点任务,而相比其他两项任务,社会管理创新更具有长远性和根本性。因此,如何推进社会管理创新成为各政法系统努力研究和竞相推进的一项重要工作。司法行政系统负责全国监狱工作、劳教工作、社区矫正工作、人民调解工作、律师工作等,承担着极为重要的任务。其中,监狱工作是司法行政系统的重要工作之一。近年来,刑罚执行和监管教育改造工作在全国司法行政系统的共同努力和其他系统的大力支持配合下,不断推进社会管理创新,结合形势发展不断出台新的规章制度,在条件具备的地方和系统内,试行某些工作,在条件成熟后,则推进立法工作的开展,取得了令人瞩目的成就,刑罚执行和监管工作实践中很多热点、难点和焦点问题得到了解决。当然也勿庸讳言,我国的监狱工作,与社会发展的整体要求相比,与人民群众的期待相比,还有很多不足和亟待改进之处,需要进一步推进管理创新,不断提高刑罚执行和监管工作法制化、现代化、正规化的程度,不断推进人权保障建设,不断为社会矛盾化解提供制度支撑。本文通过对近年来监狱系统社会管理创新工作进行归纳、梳理和研究,试图理清我国监狱工作发展的主线、脉络,找准监狱在刑罚执行、狱政管理、教育改造等方面存在的问题,为监狱工作进一步推进管理创新明确方向。论文内容包括近年来监狱管理创新的主要工作,包括监狱体制改革,监狱布局调整,现代化文明监狱建设与狱务公开建设,刑罚执行工作的法制化、科学化、社会化,罪犯人权保障建设等管理创新方面,并在深入研究的基础上,指出了目前监狱管理工作存在的主要问题及今后进一步进行管理创新的方向,包括进一步完善监狱法律体系,继续推进监狱体制改革向纵深发展,坚持并完善思想教育特色,进一步加强警察队伍建设,不断完善监狱监督机制等,在论述的角度上具有一定的新意。
[Abstract]:Social contradiction resolution, social management innovation and fair and clean law enforcement are the three key tasks of our country's political and legal organs at present. Compared with the other two tasks, social management innovation is more long-term and fundamental. Therefore, how to promote the innovation of social management has become an important work of every political and legal system. The judicial administration system is responsible for prison work, reeducation through labor, community correction, people's mediation, lawyers and so on. Among them, prison work is one of the important work of judicial administration system. In recent years, with the joint efforts of the national judicial administration system and the strong support of other systems, the enforcement of penalties and the reform of supervision and education have continuously promoted social management innovation, and continuously promulgated new rules and regulations in the light of the development of the situation. In places and systems where the conditions are available, some work is being tried out, and after the conditions are ripe, the legislative work will be carried out, and remarkable achievements have been made. Many hot spots have been achieved in the practice of penalty enforcement and supervision. Difficulties and focal points have been solved. Of course, we must not deny that our prison work, compared with the overall requirements of social development and the expectations of the people, still has many shortcomings and needs to be improved. We need to further promote management innovation. We should constantly improve the degree of legalization, modernization and formalization of punishment enforcement and supervision, constantly promote the construction of human rights protection, and provide institutional support for the resolution of social contradictions. This paper sums up, combs and studies the innovative work of prison system social management in recent years, tries to clarify the main line and context of the development of prison work in our country, and finds out the prison administration in penalty execution and prison administration. The problems in education reform and other aspects are clear direction for prison work to further promote management innovation. The contents of the thesis include the main work of prison management innovation in recent years, including prison system reform, prison layout adjustment, modern and civilized prison construction and prison affairs open construction, the legalization, scientific and socialization of penalty execution. In the aspects of management innovation, such as the construction of criminal human rights protection, and on the basis of in-depth research, this paper points out the main problems existing in the present prison administration and the direction of further management innovation in the future, including further improving the prison legal system, Continuing to promote the reform of the prison system to the depth of development, adhere to and improve the characteristics of ideological education, further strengthen the construction of the police force, constantly improve the prison supervision mechanism, and so on, in the perspective of discussion has certain new ideas.
