农村多元纠纷解决机制中乡镇政府参与问题研究

【摘要】:农村多元纠纷解决机制中乡镇政府参与是指在建设社会主义新农村的背景下,乡镇政府通过职能部门或者大调解中的政府主导来参与纠纷解决,从而实现对农村纠纷进行分流,达到化解重大疑难纠纷、妥善预防纠纷产生作用的纠纷解决方式。目前关于农村多元纠纷解决机制中的乡镇政府参与问题研究,尚无定论,学界研究也比较少。笔者试着从农村纠纷解决机制中的乡镇参与纠纷类型、方式及作用进行研究,研究这种农村多元纠纷解决机制中乡镇政府参与的正当性,针对目前实践中存在的主要问题进行分析,得出如何进一步完善农村多元纠纷解决机制中乡镇政府参与的建议,使其在和谐社会背景下更进一步发挥其作用。 本文的第一部分对农村多元纠纷解决机制与乡镇政府参与进行了介绍,分析农村多元纠纷解决机制具有独立性和规范适用上的乡土性,农村多元纠纷解决机制需要特定的条件,需要建立一支综合素质强,了解当前农民心理的纠纷解决队伍,需要结合自然地理、人文地理、区域经济等因素进行纠纷解决,在运用农村多元化纠纷解决机制的过程中要注重国家法与民间法的结合;分析了农村多元纠纷解决机制中乡镇政府参与纠纷解决的预防与妥善解决纠纷作用。 本文的第二部分是对农村多元纠纷解决机制中乡镇政府参与问题的正当性分析。从社会控制的乡土性和政治体制上的集中性对农村多元纠纷解决机制的法理正当性进行分析。现实正当性主要体现以下几个方面:民众对乡镇政府纠纷解决信念的支撑,民众对乡镇政府工作人员身份的信任,乡镇政府参与管理职能需要,乡镇政府参与纠纷解决效果明显。 本文第三部分对乡镇政府参与新农村多元化纠纷解决机制纠纷解决类型进行分析,以典型的实例如工伤纠纷和群体性纠纷介绍了农村多元纠纷解决机制中乡镇政府参与纠纷解决的具体类型;乡镇政府参与纠纷解决的方式主要有职能部门参与方式和政府主导的大调解方式;虽然乡镇政府在参与纠纷解决的过程中起到了很大的作用,但是也存在一些问题:第一,乡镇政府自身参与纠纷解决的职能存在不足;第二,乡镇政府参与纠纷解决存在不当干预;第三,乡镇政府参与纠纷解决的范围不够具体;第四,乡镇政府参与纠纷解决的人员素质参差不齐。 本文的第四部分是完善农村多元纠纷解决机制中乡镇政府参与的建议。针对存在的问题,本文提出了以下完善的建议:进一步提升乡镇政府在纠纷解决中的参与职能;乡镇政府参与需进一步规范化和程序化;进一步明确乡镇政府参与纠纷解决的范围为重大疑难案件及群体性纠纷等;提高乡镇政府纠纷解决人员的法律素养。 为此,笔者通过农村多元纠纷解决机制中乡镇政府参与问题进行分析研究,希望能对我国构建社会主义和谐社会新农村提出一些参考意见。
[Abstract]:Under the background of building a new socialist countryside, the township government participates in the dispute resolution through the function department or the government leading in the mediation, so as to realize the diversion of the rural dispute. To resolve major difficult disputes, and properly prevent disputes to play a role in dispute resolution. At present, there is no conclusion on the participation of township government in the mechanism of rural multiple dispute resolution. The author tries to study the types, ways and functions of township participation in the mechanism of rural dispute resolution, and study the legitimacy of township government participation in this mechanism. Based on the analysis of the main problems existing in the practice at present, the suggestions on how to further improve the participation of township governments in the mechanism of multi-party dispute resolution in rural areas are put forward, so that they can further play their role in the context of a harmonious society. The first part of this paper introduces the rural multi-dispute resolution mechanism and the township government participation, analyzes the rural multi-dispute resolution mechanism has the independence and the standard application of the local nature, the rural multi-dispute resolution mechanism needs the specific conditions. It is necessary to establish a dispute resolution team with strong comprehensive quality and understanding of farmers' psychology, and to resolve disputes by combining natural geography, human geography, regional economy, and so on. In the process of applying the multiplex dispute resolution mechanism in rural areas, we should pay attention to the combination of national law and folk law, and analyze the role of township government in the prevention and proper settlement of disputes in the mechanism of multi-party dispute resolution in rural areas. The second part is the legitimacy analysis of township government participation in rural multi-dispute resolution mechanism. This paper analyzes the legitimacy of the legal principle of the rural pluralistic dispute resolution mechanism from the social control of the local nature and the centralization of the political system. The legitimacy of reality mainly embodies the following aspects: the support of people's belief in the settlement of township government disputes, the people's trust in the identity of township government staff, the need for township government to participate in the management function, Township government participation in dispute resolution effect is obvious. In the third part of this paper, the author analyzes the types of the township government participating in the dispute resolution mechanism of the diversified dispute resolution mechanism in the new countryside. With typical examples, such as work-related injury disputes and group disputes, this paper introduces the specific types of township governments participating in dispute resolution in rural multi-dispute resolution mechanism. The main ways for township governments to participate in dispute resolution are the participation of functional departments and the government-led mediation. Although township governments have played a great role in the process of participating in dispute resolution, there are still some problems: first, The function of township government participating in dispute resolution is insufficient; second, there is improper intervention of township government in dispute resolution; third, the scope of township government participation in dispute resolution is not specific enough; fourth, Township governments participate in dispute resolution personnel quality is uneven. The fourth part of this paper is to improve the rural multi-party dispute resolution mechanism of township government participation. In view of the existing problems, this paper puts forward the following perfect suggestions: to further enhance the participation function of township government in dispute resolution, the participation of township government should be further standardized and procedural; To further clarify the scope of township governments to participate in dispute resolution, such as major difficult cases and group disputes, and improve the legal literacy of township government dispute resolution personnel. Therefore, through the analysis and research on the participation of township government in the mechanism of multi-party dispute resolution in rural areas, the author hopes to put forward some suggestions for the construction of a new socialist harmonious society in China.
