山东监狱基层民警执法实务研究

【摘要】：当历史迈入21世纪,监狱人民警察惩罚和改造罪犯的工作面临着新的挑战,依法治监对监狱人民警察的执法提出了更加严格的要求,押犯结构的变化更使监狱人民警察的日常工作复杂、艰巨。监狱人民警察素质的高低决定着监狱能否担负起国家所赋予的对罪犯执行刑罚的神圣职责。惩罚和改造罪犯,尤其是改造罪犯既要严格按照法律办事,又必须讲究方法和技巧。监狱的执法工作涉及程序、方法、技巧三个重要方面。由于执法的方法,特别是执法技巧没有法定的要求,在执法实践上没有统一的工作标准,工作中直接面对罪犯的基层监狱民警对许多执法实务存在困惑。本文试图结合自己监狱基层工作的实际,通过对当前监狱机关基层民警执法现状的客观分析,结合监狱学相关理论,从基层角度审视当前监狱民警执法中存在的主要问题,并提出完善监狱民警执法行为的对策和建议,以对山东省监狱基层民警执法实践提供科学的、可行的建议。 本文主体共分为五个部分。第一部分,对本课题的研究背景、研究意义、国内外研究现状、研究框架和内容进行阐述。第二部分主要论述我国监狱执法实务的含义及内容,并通过对监狱管理中的实例介绍得出监狱执法管理的独有特点。第三部分主要通过对山东省监狱基层民警执法实践的分析,从而找出监狱在执法实践中存在的主要问题并分析其原因。第四部分对国外监狱警察执法的状况和经验进行系统考察和分析,以为我国监狱民警执法提供有益借鉴。第五部分为本课题的最终落脚点,在前面四部分充分展开、论述及总结的基础上,从法规完善、队伍建设、规范管理等方面提出对完善监狱机关基层民警执法实务的对策及建议。
[Abstract]:As history enters the 21st century, the work of penalizing and reforming criminals by the prison people's police faces new challenges, and the administration of justice by law puts forward more stringent requirements for the enforcement of the law by the prison people's police. The changes in the structure of prisoners make the daily work of the prison people's police more complicated and arduous. The quality of the prison people's police determines whether the prison can shoulder the sacred duty of the state to carry out the punishment to the criminal. Punishing and reforming criminals, especially reforming criminals, must not only strictly follow the law, but also pay attention to methods and techniques. Prison law enforcement involves three important aspects: procedure, method and technique. Because the law enforcement method, especially the law enforcement skill does not have the legal requirement, does not have the unified work standard in the law enforcement practice, in the work directly faces the criminal basic prison police to many law enforcement practice existence confusion. This paper attempts to combine with the practice of the basic prison work, through the objective analysis of the present situation of the enforcement of the law by the basic police of the prison authorities, and with the relevant theories of prison science, this paper examines the main problems existing in the enforcement of the law of the prison police from the perspective of the grass-roots level. The countermeasures and suggestions of perfecting the law enforcement behavior of prison police are put forward in order to provide scientific and feasible suggestions for the law enforcement practice of the basic prison police in Shandong Province. The main body of this paper is divided into five parts. The first part, the research background, research significance, domestic and foreign research status, research framework and content are described. The second part mainly discusses the meaning and content of the practice of prison law enforcement in China, and obtains the unique characteristics of prison law enforcement management by introducing the examples of prison management. The third part analyzes the law enforcement practice of the basic prison police in Shandong Province and finds out the main problems existing in the prison law enforcement practice and analyzes the reasons. The fourth part makes a systematic investigation and analysis on the situation and experience of foreign prison police law enforcement to provide useful reference for our country's prison police law enforcement. The fifth part is the final foothold of this subject, in the first four parts of the full development, on the basis of discussion and summary, from the legal perfection, team building, The countermeasures and suggestions on how to perfect the law enforcement practice of the basic police in prison institutions are put forward in the aspects of standardized management and so on.
