广东省佛山市镇(街)法律监督工作调查研究

【摘要】:本文是在广东省“简政强镇”改革的背景下,以2008年至今佛山市检察机关镇(街)检察室的工作模式和实际情况为调研对象,结合我国乡镇检察室的发展历史、作用及局限性,深入分析我国构建镇(街)法律监督工作机制的必要性与可行性,并通过比较我国其他地区开展镇(街)法律监督工作的不同模式,在分析各种模式的利弊基础上,提出了在镇(街)基层建立法律监督工作机制的整体方案建议。 本文分为五个部分。 第一部分论述了调研的目的和意义:首先介绍了“简政强镇”改革的调研背景;其次说明了期待通过实证考察达到推动我国镇(街)法律监督工作机制改革的目的;再次阐述了本文的理论意义与实践价值。本文在相同领域的理论研究属于首创,填补了我国关于镇(街)法律监督工作机制研究的空白;提出的建构对策有利于促进我国镇(街)法律监督工作机制的建立与完善,,并且,佛山市检察机关推行的镇(街)法律监督工作机制属于在现有检察体制内进行的改革,不需要突破现有法律法规,有很强的实际推广价值。 第二部分阐述了调研的方法和对象:本文采取了比较分析、历史分析和实证分析的研究方法,调研对象为佛山市检察院2008年以来在顺德区乐从镇等33个镇(街)基层组织创造性地设立镇(街)检察室的工作思路、机制构建以及实际运作方式、运作成效等。 第三部分详细阐述了调研结果:首先介绍了佛山市检察机关开展镇(街)法律监督工作的背景;其次认真梳理了2008年以来佛山市检察机关镇(街)检察工作的人员配备、工作职责、工作成效和主要问题。 第四部分分析与讨论:重点论述了构建镇(街)法律监督机制的必要性和可行性,并结合我国乡镇检察工作的历史沿革,比较分析了我国派出(联系)机构的两种最主要的模式,得出检察室模式更适合我国国情的结论。 第五部分结论与建议:提出设立镇(街)检察机构应当遵循对应设立、独立工作和目标管理原则,名称应统一为“检察室”,组织体制结构设置应当是“立体的二级结构”,职能定位应以强化法律监督职能为基础,以服务业务部门为职能载体。
[Abstract]:Under the background of the reform of "Jianzheng strong Town" in Guangdong Province, this paper takes the working mode and actual situation of the procuratorial office of Foshan procuratorial organ since 2008 as the research object, and combines the development history, function and limitation of the procuratorial office of the township in our country. This paper deeply analyzes the necessity and feasibility of constructing the mechanism of legal supervision in towns (streets) in our country, and compares the different modes of legal supervision of towns (streets) in other areas of our country, on the basis of analyzing the advantages and disadvantages of the various models. Proposed in the town (street) grass-roots establishment legal supervision work mechanism the overall plan proposal. This paper is divided into five parts. The first part discusses the purpose and significance of the investigation: firstly, it introduces the research background of the reform of "simple and strong town"; secondly, it explains the purpose of promoting the reform of the legal supervision mechanism of our country's towns (streets) through empirical investigation. Again, this paper expounds the theoretical significance and practical value. The theoretical research in the same field is the first in this paper, which fills the blank of the research on the legal supervision mechanism of the town (street) in our country. The constructive countermeasures put forward are conducive to the establishment and perfection of the mechanism of legal supervision in towns (streets) in our country. Moreover, the mechanism of legal supervision in towns (streets) implemented by procuratorial organs in Foshan belongs to the reform carried out within the existing procuratorial system. Do not need to break through the existing laws and regulations, has a strong practical promotion value. The second part describes the research methods and objects: this paper adopts comparative analysis, historical analysis and empirical analysis. The object of investigation is the creative establishment of procuratorial office in 33 towns (streets) such as Lecong Town Shunde District since 2008 by Foshan Procuratorate. The third part elaborated the investigation result in detail: first introduced the Foshan procuratorial organ to carry out the town (street) the legal supervision work background; Secondly, the author carefully combs the staffing, duties, results and main problems of the procuratorial work in Foshan since 2008. The fourth part analyzes and discusses the necessity and feasibility of constructing the legal supervision mechanism of the town (street), and combines the historical evolution of the procuratorial work of the township in our country. This paper compares and analyzes the two most important modes of the dispatch agencies in China, and draws the conclusion that the mode of procuratorial office is more suitable for the national conditions of our country. Part V conclusions and suggestions: it is suggested that the establishment of a town (street) procuratorial organ should follow the principles of corresponding establishment, independent work and objective management, that the name should be unified as "procuratorial room", and that the organizational system structure should be set up as "three-dimensional secondary structure". The function orientation should be based on strengthening the legal supervision function and the service business department should be the function carrier.
