当前我国罪犯分类管理制度研究

【摘要】：分类管理是现代监狱管理制度的重要组成部分,对罪犯进行分类管理是提高改造质量的保证,是衡量一个国家监狱工作水平的重要标志之一。我国现行的罪犯分类管理制度已经明显滞后于实践需要,因此,创新与完善罪犯分类管理制度是监狱工作发展的必然要求,具有重要的现实意义。本文首先对罪犯分类的涵义、罪犯分类管理制度的定义、内容、作用以及基本要求进行了详细地阐述,使我们能够系统地掌握罪犯分类管理制度的理论知识。其次,分析我国的罪犯分类管理制度的现状。介绍我国罪犯分类管理的历程,结合当前我国犯罪的形势和特点,从中深刻揭示我国犯罪的主要原因,总结我国在罪犯分类管理取得的成绩,提出存在的问题。本文除了分析我国罪犯分类管理制度,还格外重视汲取各国的罪犯分类管理制度的经验。分别对美国、英国和日本三国的罪犯分类管理制度进行研究,从中得到一些启示。最后,结合自我分析和借鉴经验,本文提出了完善我国的罪犯分类管理制度的对策。加强理论研究,完善法律体系；建立分类调查机构；建立罪犯分类的经费保障制度、培养专家型警察队伍；重视和加强未成年罪犯的分类管理制度。本文的根本目的在于创建具有中国特色的罪犯分类管理制度,提高行刑效率。
[Abstract]:Classified management is an important part of the modern prison management system. Classified management of criminals is the guarantee to improve the quality of rehabilitation and one of the important symbols to measure the level of prison work in a country. The current criminal classification management system in China has obviously lagged behind the practical needs. Therefore, the innovation and perfection of the criminal classification management system is the inevitable requirement of the development of prison work, and has important practical significance. In this paper, the meaning of criminal classification, the definition, content, function and basic requirements of criminal classification management system are described in detail, so that we can grasp the theoretical knowledge of criminal classification management system systematically. Secondly, analyze the current situation of the criminal classification management system in our country. This paper introduces the course of classified management of criminals in our country, combined with the current situation and characteristics of crime in our country, reveals the main causes of crimes in our country deeply, summarizes the achievements made in the classified management of criminals in our country, and puts forward the existing problems. This paper not only analyzes the criminal classification management system in China, but also pays more attention to the experience of the criminal classification management system in various countries. The classification and management system of criminals in the United States, Britain and Japan are studied, and some enlightenments are obtained. Finally, combined with self-analysis and experience, this paper puts forward the countermeasures to perfect the criminal classification management system in China. We should strengthen the theoretical research, perfect the legal system, establish the classification investigation institution, establish the funds guarantee system for the classification of criminals, train the expert police force, and attach importance to and strengthen the classification and management system of juvenile criminals. The basic purpose of this paper is to establish the criminal classification management system with Chinese characteristics, and to improve the efficiency of execution.
