欧盟补贴与反补贴法律制度研究

【摘要】：继2010年4月17日欧盟对中国铜版纸发起首次反补贴立案调查以来,欧盟陆续对中国产无线广域网卡以及数据卡启动了反补贴调查。至此,欧盟对中国产品的反补贴诉讼终于全面展开。2011年2月11日,欧盟披露对华铜版纸反补贴终裁结果:今后五年向中国产铜版纸征收16%的反补贴税,由此可以看出金融危机发生后经济遭受重创的欧盟明显的产业保护意图。此“口”一开,中国产品可能还会遭受更多的反补贴调查,中国企业在欧盟市场上将面临巨大的压力。为保护我国在对欧盟贸易中的利益,研究欧盟反补贴程序规则和实体规则既有理论意义,又有实践价值。由于反补贴法是一部实践性较强的法律,因此,本文通过案例研究等方法,结合司法案例,全面分析欧盟运用反补贴调查的情况,并由此全面阐释欧盟反补贴制度,以期从中探寻应对欧盟反补贴的可行之道。本文包括四个部分。第一部分回顾欧盟反补贴法的发展历程,对欧盟反补贴法的发展轨迹进行阐述。第二部分重点论述欧盟反补贴实施机构及欧盟反补贴实体及程序制度。该部分首先对欧盟委员会,欧盟理事会和欧盟咨询委员会作为反补贴实施机构的职责及其各自的作用进行分析,之后阐释欧盟反补贴实体法部分内容,对补贴的认定、损害的认定、因果关系认定、欧盟利益要求采取措施这四个法律构成要件的内涵进行阐述。最后,本部分对欧盟程序规则,包括调查程序、欧盟的反补贴裁决、欧盟的反补贴复审进行了详细概述。第三部分分析欧盟对发展中国家、发达国家发起的具有代表性的反补贴诉讼案例,揭示欧盟反补贴法实践概况。第四部分提出完善我国的反补贴立法,应对欧盟反补贴调查的立法建议和应对策略,以求为我国反补贴立法和实践提供参考和借鉴。
[Abstract]:Since April 17th 2010, the European Union launched the first anti-subsidy investigation against China's coated Paper, the European Union has launched a countervailing investigation on wireless WAN cards and data cards made in China one after another. On February 11th 2011, the European Union disclosed the final result of countervailing on Chinese coated paper: 16% countervailing duties will be levied on Chinese coated paper in the next five years. This shows the obvious industrial protection intentions of the European Union, which was hit hard after the financial crisis. As soon as this "mouth" opens, Chinese products may be subject to more countervailing investigations. Chinese enterprises will face great pressure in the EU market. In order to protect the interests of our country in trade with EU, it is of theoretical significance to study the EU countervailing procedural rules and substantive rules. Because countervailing law is a practical law, this paper, through case study and judicial cases, comprehensively analyzes the use of countervailing investigation in EU. From this, the paper comprehensively explains the countervailing system of EU, in order to explore the feasible way to countervail the EU. This paper includes four parts. The first part reviews the development of EU countervailing law. The second part focuses on the EU countervailing enforcement agencies and the EU countervailing entities and procedural system. The European Council and the European Union Advisory Committee as the countervailing implementation agency and their respective roles are analyzed, and then explains the EU countervailing substantive law, the recognition of subsidies, the recognition of damage. Causal relationship, EU interests require the adoption of measures of the meaning of the four elements of the law. Finally, this part of the EU procedural rules, including investigation procedures, EU countervailing rulings. The third part analyzes the representative cases of countervailing litigation initiated by the EU against developing countries and developed countries. Reveal the practice of EU countervailing law. Part 4th puts forward to perfect our countervailing legislation, and the legislative suggestions and countermeasures to the EU countervailing investigation.
