论经常居所地法在我国的适用

【摘要】：经常居所地法在《中华人民共和国涉外民事关系法律适用法》(下文简称《法律适用法》)中得到大量的适用,《法律适用法》甚至抛弃和减弱了传统属人法---住所地法和国籍国法在涉外民事关系中的适用。由此可见,经常居所地法对《法律适用法》实施的意义是很重大的,所以对经常居所地法在我国的适用进行全面的剖析理解是很有必要的。本文首先梳理了传统属人法的内容,介绍了经常居所地法在国际上兴起的背景和原因,在此基础上分析经常居所地法的核心---经常居所作为连结点的概念和内涵,区分其与邻近概念的区别,这样才能更加深入的理解经常居所地法的内涵。其次,在分析我国的立法和司法现状基础上,提出当前经常居所地法在我国的适用仍存在新旧法律规定不同、属人法选择过于单一和连结点概念模糊、某些规定还存在不合理的情形等问题。最后,在立足我国国情、结合国内外立法经验的基础上,提出应该出台新的司法解释对旧法中的一些不规范、不准确的概念进行清理并明确规定新旧法律冲突时的解决办法；吸收国外在属人法选择上的先进经验,将住所地法和国籍国法根据不同情况作为经常居所地法的补充适用原则；并根据立法意图,结合国外相关规定,明确界定经常居所地的概念,对生活中心的建立、居住期限进行具体规定并删除除外情形中的劳务派遣及公务情形,从而使其在实践中得到准确与合理的适用；最后对于《法律适用法》中某些规定的不合理之处直接给出修改意见,希望对经常居所地法更好的在我国的适用提供有益的参考。
[Abstract]:The law of the place of habitual residence is widely applied in the Law of the people's Republic of China on the legal Application of Foreign Civil Relations (hereinafter referred to as the "applicable Law of Law"). The applicable Law of Law even abandons and weakens the application of the traditional personal law-domicile law and nationality law in the civil relations involving foreign affairs. The law of habitual residence is of great significance to the implementation of the applicable Law. Therefore, it is necessary to analyze and understand the application of the law of regular residence in our country. Firstly, this paper combs the content of traditional personal law, and introduces the background and reason of the emergence of the law of regular residence in the world. On this basis, it analyzes the concept and connotation of the core of the frequent residence method---regular residence as a connecting point, and distinguishes it from the concept of proximity. In this way, we can understand the connotation of the law of regular residence more deeply. Secondly, on the basis of analyzing the current legislative and judicial situation of our country, the author points out that there are still differences between the new and the old laws in the application of the current law of habitual residence in our country. The choice of personal law is too single and the concept of connecting point is vague, and some provisions still exist unreasonable situation. Finally, based on the national conditions of our country, combined with the domestic and foreign legislative experience. It is suggested that a new judicial interpretation should be introduced to clean up some unstandardized and inaccurate concepts in the old laws and to clearly define the solutions to the conflicts between the old and the new laws. Absorbing the advanced experience of foreign countries in the choice of personal law, taking the law of domicile and the law of nationality as the supplementary application principle of the law of habitual residence according to different situations; And according to the legislative intent, combined with the relevant provisions of foreign countries, the concept of regular residence is clearly defined, the establishment of the living center, the duration of residence are specified and the exception of labor dispatch and official service is deleted. In order to make it in practice to get accurate and reasonable application; In the end, some unreasonable provisions in the applicable Law of the Law are directly amended, hoping to provide a useful reference for the application of the law of habitual residence in our country.
