联合国人权理事会的国际组织法透视

【摘要】：2006年3月15日,第60届联合国大会以170票赞成、4票反对、3票弃权的表决结果通过251号决议,决定设立新的人权理事会来处理联合国系统内部人权事务,包括大规模地、系统地侵犯人权的行为。2006年6月19日,联合国人权理事会首届会议在瑞士日内瓦举行,宣告运行60年的联合国人权委员会的终结,一个新的处理国际人权事务的机构正式开始运作。目前(截止2011年3月),人权理事会共召开了16届会议和15届特别会议。人权理事会还处于初级阶段,研究者们从国际组织法的角度对人权理事会的研究还不够深入。有鉴于此,笔者想从国际组织法的角度对联合国人权理事会进行透视。本文共分为七章：第一章简要介绍本文的研究背景及意义、国内外的研究现状、本文的研究方法和创新之处；第二章人权理事会的前身：介绍人权委员会的设立背景、贡献以及存在的不足、向人权理事会过渡；第三章是本文的重点章,主要从国际组织法的角度,进一步阐述人权理事会的章程、人权理事会的设立目的和法律地位、人权理事会的成员国、人权理事的职能、人权理事会的议事规则等主要国际组织法问题。第四章阐述人权理事会对人权委员会的继受和革新；第五章对人权理事会四年多的实践进行综述,即从人权理事会在国际人权立法、国际人权保护制度主要是对人权理事会的普遍定期审议机制进行阐述,同时分析人权理事会所存在的问题,并对人权理事会的前景进行展望。第六章论述中国对人权理事会的贡献,以及中国自愿承担的国际义务；第七章为结论,主要是尝试探索人权理事会对国际组织法的影响。
[Abstract]:In March 15, 2006, the sixtieth session of the UN General Assembly by 170 votes in favor, 4 votes against, 3 abstentions passed resolution 251, decided to set up a new Human Rights Council to deal with human rights issues within the United Nations system, including large-scale, systematic violations of human rights.2006 in June 19th, the UN Human Rights Council meeting held in the first Geneva Switzerland, announce the end 60 years of operation of the United Nations Commission on human rights, an international human rights affairs agency new officially started operation. Currently (as of March 2011), the Human Rights Council convened the 16 session and the 15 special session of the human rights Council is still in the initial stage, the researchers from the international organization law study on the Human Rights Council is not deep enough. In view of this, the author wants to focus on the UN Human Rights Council from the international law angle.
This paper is divided into seven chapters: the first chapter the research background and significance are briefly introduced in this paper, the research status at home and abroad, research methods and innovations in this paper; the second chapter of the Human Rights Council predecessor: the establishment of background of the Commission on human rights, contributions and deficiencies, to the Human Rights Council transition; the third chapter is the key chapter of this paper the organization mainly from the international law angle, further elaborated the Human Rights Council's constitution, the Human Rights Council to set up and the legal status of the Human Rights Council member of the Human Rights Council, the functions of the human rights Council on the rules of the main international organization law. The fourth chapter of the Human Rights Council and following the reform of the Commission on human rights; the fifth chapter summarizes the practice of the Human Rights Council for more than four years, from the Human Rights Council on international human rights legislation and international human rights protection system mainly is the director of human rights The universal periodic review mechanism is expounded, and analysis of the existing Human Rights Council, and the Council's prospect. The sixth chapter discusses the contribution of the Human Rights Council China, and China international obligations voluntarily assumed; the seventh chapter is the conclusion, mainly attempts to explore the impact of Human Rights Council on international law.
