涉外足球劳动合同争议中的国际私法问题的特殊性

【摘要】：竞技足球运动具有天然的国际性,作为涉外民事关系的一部分,球员和俱乐部之间的涉外足球劳动合同同样属于国际私法的调整范围。然而,区别于普通的涉外民事关系,涉外足球劳动合同争议中的国际私法问题的处理存在特殊性。就涉外足球劳动合同争议的涉外因素而言,由于足球领域的国是指构成国际足联成员的各足协管辖的区域,实践中更关注隶属于不同足协的俱乐部之间的转会以及球员的体育国籍;就涉外足球劳动合同争议的管辖权确立而言,尽管理论上国际足联争端解决委员会基于当事人的约定有权受理此类案件,没有否定法院管辖的可能,但在实践中除非存在排他性的选择法院协议,否则其不欢迎司法介入;就涉外足球劳动合同争议的法律适用而言,为了实现劳动合同的稳定性,争议解决主要适用国际足联制定的统一规则,传统国际私法中的冲突规范指引准据法的作用有限;就涉外足球劳动合同争议所作裁决的承认与执行而言,由于国际足联采用自执行的方式,无论其争端解决委员会还是扮演上诉机构角色的国际体育仲裁院作出的裁决一般不会寻求法院的协助。此种作法往往被视为社团自主的范畴,从而多免于遭受司法审查。
[Abstract]:Competitive football has a natural international character. As a part of the foreign civil relations, the foreign football labor contract between players and clubs is also within the scope of adjustment of private international law. Different from the ordinary foreign civil relations, there are particularities in the handling of the private international law issues in the foreign football labor contract disputes. As far as the foreign factors of the foreign football labor contract disputes are concerned. Because the country in the field of football refers to the area under the jurisdiction of the football federations which constitute the members of FIFA, in practice, more attention is paid to the transfer between clubs belonging to different football associations and the sports nationality of the players. As far as the establishment of jurisdiction over foreign football labour contract disputes is concerned, although in theory the FIFA dispute settlement Committee has the power to accept such cases on the basis of the agreement of the parties, there is no possibility of denying the jurisdiction of the court. But in practice, unless there is an exclusive choice of court agreement, it does not welcome judicial intervention; As far as the legal application of foreign football labor contract disputes is concerned, in order to realize the stability of the labor contract, the dispute settlement mainly applies to the uniform rules formulated by FIFA. In the traditional private international law, the role of the applicable law in the guidance of conflict norms is limited; As far as the recognition and enforcement of decisions made in disputes over foreign football labour contracts are concerned, FIFA adopts a self-executing approach. Decisions made by the International Court of Sport Arbitration, whether its dispute settlement Board or the International Court of Arbitration as an appellate body, do not normally seek the assistance of courts... this practice is often considered to be within the scope of association autonomy. Thus many are exempt from judicial review.
