中欧地理标志互认机制对我国立法的启示

【摘要】:中国欧盟开展的“10+10”地理标志互认机制为我国地理标志产品走向世界舞台提供了机遇,同时也为我国在以后的地理标志国际发展中提供了可以借鉴的发展模式——即开展地理标志国际互认。本文主要是以中欧地理标志互认机制的开展为切入点,探讨如何完善国内地理标志立法以促进地理标志国际互认的开展。 本文首先介绍中国欧盟地理标志互认制度发展的历程。从中国分别同法国、意大签订双边协议,到中国同欧盟开启地理标志互认,该模式已经经历了法律法规的研讨、保护范围的认定、人员培训等一系列的前期准备工作。 本文第二部分介绍了中国欧盟地理标志互认的法律分析。中欧是在TRIPS协议框架下开展地理标志国际互认机制。在本部分主要介绍TRIPS协议有关地理标志的规定,以及目前我国现存的三种保护地理标志的法律制度、欧盟一级有关地理标志的相关规定。根据《中华人民共和国国家质量监督检验检疫总局与欧洲委员会贸易总司关于地理标志的谅解备忘录》分析中国地理标志在欧盟、欧盟地理标志在中国获得保护的法律基础。 文章的第三部分在分析在经济全球化对地理标志发展的影响下,探求地理标志互认的发展趋势,研究TRIPS协议框架下中国欧盟地理标志互认机制存在必要性以及我国同欧盟以外国家或地区进行地理标志双边或多边国际互认的可行性以及必要性。 文章第四部分探讨地理标志国际互认机制的开展折射出的目前我国地理标志法律制度存在的地理标志国际互认中主管部门不统一、法律依据不统一以及地理标志同商标的权利冲突等问题。基于对地理标志国际互认机制在以后地理标志国际合作中发展的前瞻和世界各国保护地理标志的不同法律模式以及中国地理标志法律保护的现状,得出中国应选择专门法和商标法双轨制的保护模式。采用地理标志专门法和商标法双轨制保护模式后,我国应立足改善国内地理标志相关法律制度以利于我国未来开展地理标志国际互认。
[Abstract]:The mutual recognition mechanism of "10 10" geographical indications carried out by China and the European Union provides an opportunity for China's geographical indication products to move to the world stage. At the same time, it also provides our country with a development model that can be used for reference in the future international development of geographical indications-that is, the development of international mutual recognition of geographical indications. This paper mainly focuses on the development of mutual recognition mechanism of geographical indications between China and Europe. This paper probes into how to perfect domestic legislation of geographical indication to promote the development of international mutual recognition of geographical indications. This paper first introduces the course of the development of the mutual recognition system of geographical indications between China and the European Union. From the signing of bilateral agreements between China and France and Italy, to the opening of mutual recognition of geographical indications between China and the European Union, the model has already gone through the discussion of laws and regulations. The identification of the scope of protection, personnel training and a series of preparatory work. The second part of this paper introduces the legal analysis of the mutual recognition of geographical indications between China and the European Union. China and Europe carry out the international mutual recognition mechanism of geographical indications under the framework of the TRIPS Agreement. In this part, we mainly introduce the provisions of the TRIPS Agreement on geographical indications. As well as the three existing legal systems for the protection of geographical indications in China, According to the Memorandum of understanding between the General Administration of quality Supervision, Inspection and Quarantine of the people's Republic of China and the General Bureau of Trade of the European Commission on geographical indications, The legal basis for the protection of EU geographical indications in China. In the third part of the article, under the influence of economic globalization on the development of geographical indications, the author explores the development trend of mutual recognition of geographical indications. This paper studies the necessity of the mutual recognition mechanism of geographical indications between China and EU under the framework of TRIPS and the feasibility and necessity of bilateral or multilateral mutual recognition of geographical indications between China and other countries or regions outside the EU. In the 4th part, the author discusses that the international mutual recognition mechanism of geographical indications reflects the disunity of the competent departments in the international mutual recognition of geographical indications in the current legal system of geographical indications in China. Problems such as the disunity of legal basis and the conflict of rights between geographical indications and trademarks. Based on the prospect of the development of the international mutual recognition mechanism of geographical indications in the future and the different laws of protecting geographical indications in various countries of the world. The law model and the current situation of the legal protection of geographical indications in China, It is concluded that China should choose the protection mode of the dual track system of the special law and the trademark law. After adopting the dual track protection mode of the special geographical indication law and the trademark law, Our country should improve the domestic geographical indication related legal system in order to develop the international mutual recognition of geographical indication in the future.
