叙利亚难民法律保护研究

【摘要】：叙利亚难民问题因叙利亚内战自2011年开始,一直持续至今。大量的叙利亚难民生活在水深火热之中,因为身份的特殊,他们的权利极易受到侵犯,不能依据国际法和欧盟的难民条约来很好的维护自己的利益。叙利亚难民的权利的保护需要国际社会和各主权国家的共同努力。本文主要从四个方面来论述。第一部分是第一、二章,对难民的定义概念进行了解释,并对于本文的研究对象叙利亚难民的成因、现状及其对欧洲的影响进行了分析。第二部分是第三章,主要论述对叙利亚难民进行法律保护的依据,国际和欧洲对叙利亚难民保护的现状以及遵循的基本原则。本文的重点是第三部分,即论文的第四、第五章。第四章对于当前针对叙利亚难民的法律保护存在的缺陷进行了分析,指出了其存在的不足和问题,第五章提出了对于难民法律权利保护的建议和完善的措施,包括:国际组织和主权国家发挥职责、各国间加强协调、欧盟完善其难民条约、改进国际性的难民地位公约,各国家也要加强自己的难民立法。
[Abstract]:The Syrian refugee problem, due to the Syrian civil war, has continued since 2011. A large number of Syrian refugees live in dire straits, and because of their special status, they are extremely vulnerable to violations of their rights. The protection of the rights of Syrian refugees requires the joint efforts of the international community and the sovereign states. This paper mainly discusses from four aspects. The first part is the first part. In chapter two, the definition of refugees is explained, and the causes, current situation and impact on Europe of the Syrian refugees are analyzed. The second part is the third chapter. This paper mainly discusses the basis of the legal protection of Syrian refugees, the current situation of international and European protection of Syrian refugees and the basic principles to be followed. The emphasis of this paper is the third part, that is, 4th of the thesis. Chapter 5th. Chapter 4th analyzes the shortcomings of the current legal protection of Syrian refugees, points out its shortcomings and problems, and Chapter 5th puts forward some suggestions and measures for the protection of the legal rights of refugees. These include: international organizations and sovereign states to perform their duties, countries to strengthen coordination, the European Union to improve its refugee treaties, to improve the international Convention on the status of Refugees, and countries to strengthen their own refugee legislation.
