港口国对船舶压载水监管的法律机制问题研究

【摘要】：本文以港口国对船舶压载水监管法律机制为研究对象。通过分析《国际船舶压载水和沉积物控制与管理公约》下港口国监控的内容,比较研究各国涉及船舶压载水港口国监管的法律规范,明确了建立港口国压载水监管法律机制的必要性,并对该法律机制所包含的具体内容作出论述,为我国制定具体的港口国压载水监管法律规范提供参考,以期弥补我国在船舶压载水港口国监管领域内法律机制的缺失。文章共分为四个部分,具体内容如下： 第一部分是对港口国船舶压载水监管法律机制的概述。首先,明确了船舶压载水管理与港口国监督之间的法律关系,通过对船舶压载水诱发外来生物入侵及其危害的分析,确认了船舶压载水港口国监管的基本内容。然后,引入法律机制的概念,结合社会法理学的基本理论,指明法律机制在该项监管制度中的重要意义,进而提出将法律机制与行政监管相结合的设想。 第二部分是对《压载水公约》下港口国监管内容的分析,主要明确了港口国对船舶压载水监管的职权范围以及具体可以采用的措施,为我国建立港口国对船舶压载水监管制度提供可靠的参考依据。 第三部分是对各国关于船舶压载水港口国监管法律规范的比较研究,运用比较法学的方法论分析各国的法律规范体系和具体的监管措施,研究其中适合我国以港口国身份对压载水进行监督和管理的具体制度,为构建我国的船舶压载水港口国监管法律机制提供启示。 第四部分主要是分析我国存在问题,并在此基础上提出应对措施。本部分重点参考前三部分的研究成果,并结合我国现有的法律规范和港口国监督体制,构建我国的船舶压载水港口国监管法律机制,明确我国港口国监管的主管机关和具体监管制度。
[Abstract]:In this paper, the legal mechanism of port state control over ship ballast water is taken as the research object, and the contents of port state control under the International Convention on the Control and Management of ship Ballast Water and sediments are analyzed. This paper makes a comparative study on the legal norms of the port state control of ship ballast water in various countries, clarifies the necessity of establishing the legal mechanism of port state ballast water supervision, and discusses the concrete contents of the legal mechanism. In order to make up for the lack of legal mechanism in the field of ship ballast water supervision, the article is divided into four parts, the specific contents are as follows:. The first part is an overview of the legal mechanism of port state ballast water supervision. Firstly, it clarifies the legal relationship between ship ballast water management and port state control, and analyzes the invasion and harm of foreign organisms induced by ship ballast water. The basic contents of the port state supervision of ships ballast water are confirmed. Secondly, the concept of legal mechanism is introduced and the important significance of legal mechanism in the supervision system is pointed out by combining with the basic theory of social jurisprudence, And then put forward the idea of combining the legal mechanism with administrative supervision. The second part is the analysis of the content of port state control under the ballast water convention, which mainly clarifies the terms of reference of port state to ship ballast water control and the concrete measures that can be adopted. It provides a reliable reference for establishing port state supervision system of ship ballast water in China. The third part is a comparative study on the legal norms of port state supervision of ships ballast water, using the methodology of comparative law to analyze the legal regulatory system and specific regulatory measures. This paper studies the specific system suitable for our country to supervise and manage ballast water as a port state, and provides inspiration for constructing the legal mechanism of port state supervision of ship ballast water in our country. The 4th part mainly analyzes the existing problems in our country, and puts forward some countermeasures on this basis. This part mainly refers to the research results of the first three parts, and combines the existing legal norms and port state control system of our country. The legal mechanism of port state supervision of ship ballast water in China is constructed, and the competent authority and specific supervision system of port state supervision in China are clarified.
