中国参与北极航运治理的国际法依据研究

【摘要】:北冰洋海冰消融使得北极航道得以开通,而北极航道的利用也带来了相应的治理需求。作为世界航运大国,中国在北极享有航行、航行中的安全保障和环境保护以及航行中的搜寻和救助权利义务。《联合国海洋法公约》和《极地水域船舶航行国际准则》等国际法律制度为中国参与北极航运治理提供了国际法依据。现有国际法依据主要围绕《联合国海洋法公约》展开,同时它们还显现出了从软法向硬法过渡以及全球性条约区域化的特征。基于此,中国可以通过加强与北极国家合作以及提升本国履约能力等方式,充分利用相关国际法依据,积极参与北极航运治理。
[Abstract]:The melting of sea ice in the Arctic Ocean has enabled the opening of the Arctic waterway, and the utilization of the Arctic waterway has brought about a corresponding demand for governance. As a major shipping country in the world, China enjoys navigation in the Arctic. Safety and security during navigation and environmental protection, as well as search and rescue rights and obligations during navigation. International legal regimes, such as the United Nations Convention on the Law of the Sea and the International guidelines for Navigation of ships in Polar Waters, provide China with the right to participate in Arctic shipping. The rationale provides the basis of international law... the existing basis of international law revolves primarily around the United Nations Convention on the Law of the Sea, At the same time, they also show the characteristics of the transition from soft to hard law and the regionalization of global treaties. Based on this, China can make full use of the relevant basis of international law by strengthening cooperation with Arctic countries and enhancing its ability to comply with the law. Actively participate in Arctic shipping governance.
