国际商事仲裁之司法监督制度研究

【摘要】:随着经济全球化时代的到来,国际经济贸易往来日益频繁背景下,国际商事仲裁因其民间性和效率性逐渐被人们所接受,成为了解决国际商事纠纷的重要手段。与此同时,基于维护仲裁公正性和仲裁效率性的目的,国际商事仲裁的司法监督也成为了学界热议的话题。应当说随着国际商事仲裁制度的发展,仲裁司法监督制度也同步得到了发展。因此,在国际商事仲裁制度不断走向繁荣的今天,讨论国际商事仲裁司法监督制度还是十分有意义的。 本文主要分为三大部分,分别对国际商事仲裁司法监督制度展开论述。第一部分首先从分析国际商事仲裁的制度概况入手,指出国际商事仲裁制度在效率和公平价值上存在着天然的冲突性,并将之作为国际商事仲裁的司法监督制度产生和存在的法理依据。然后揭示出国际商事仲裁的契约性、准司法性和社会性的特点,以及国家基于当事人权利救济的考虑,引入司法权的干预以对其进行司法监督的必要性。 第二部分首先厘清国际商事仲裁司法监督制度的概念界定,并分析该制度的特点。接着提出国际商事仲裁司法监督必须坚持的原则,即程序公正原则、依法监督原则、权利保护原则、维护主权原则以及衡平审查原则。然后在分析现有关于国际商事司法监督范围的“全面监督论”和“程序监督论”两种理论的基础上,笔者认为法院在对国际商事仲裁司法监督之时,应当坚持以程序为主的监督模式。对于实体问题的审查,则要在以尊重当事人意思自治的基础上进行。在承认和执行外国商事仲裁之时,仅仅以违反本国公共政策为理由对实体问题进行审查。最后,文章从程序和实体两个角度对国际商事仲裁司法监督的范围进行全面阐述。 第三部分则从对我国国际商事仲裁司法监督概况的分析为起点,揭示出我国国际商事仲裁司法监督制度存在着过于注重公平而牺牲效率、采取国内仲裁和涉外仲裁双轨制模式、可仲裁性事项不明以及重新仲裁制度规定不清等缺陷。进而从上述问题出发,提出在坚持效率和公平相结合的监督理念的基础上改变双轨制模式、完善程序监督中的相关机制、合理安排重新仲裁制度、重新限定司法审查时限等改革措施。最后结合未来国际商事仲裁制度的发展特点,对我国国际商事仲裁司法监督制度的发展趋势进行展望。
[Abstract]:With the arrival of the era of economic globalization and the increasing frequency of international economic and trade contacts, international commercial arbitration has gradually been accepted by people because of its folklore and efficiency, and has become an important means to solve international commercial disputes. In order to maintain the fairness and efficiency of arbitration, judicial supervision of international commercial arbitration has become a hot topic in academic circles. It should be said that with the development of international commercial arbitration system, Therefore, it is very meaningful to discuss the judicial supervision system of international commercial arbitration at a time when the system of international commercial arbitration continues to flourish. This paper is divided into three parts, respectively, the judicial supervision system of international commercial arbitration is discussed. The first part begins with the analysis of the system of international commercial arbitration. It is pointed out that the international commercial arbitration system has natural conflict in efficiency and fair value, which is regarded as the legal basis for the emergence and existence of the judicial supervision system of international commercial arbitration, and then reveals the contractual nature of international commercial arbitration. The characteristics of quasi-judicial and social, and the necessity of introducing judicial intervention in order to supervise the rights of the party concerned based on the consideration of the relief of the rights of the party concerned. The second part first clarifies the definition of the judicial supervision system of international commercial arbitration, and analyzes the characteristics of the system. Then, it puts forward the principle that the judicial supervision of international commercial arbitration must adhere to, that is, the principle of procedural justice and the principle of supervision according to law. The principle of protection of rights, the principle of safeguarding sovereignty and the principle of equitable review. Then, based on the analysis of the existing theories of "comprehensive supervision" and "procedural supervision" on the scope of international commercial judicial supervision, The author thinks that when the court supervises the international commercial arbitration judicially, it should adhere to the mode of supervision based on procedure. On the basis of respect for party autonomy... when foreign commercial arbitration is recognized and enforced, the substantive issue is examined solely on the grounds of violation of the public policy of the State... finally, This paper comprehensively expounds the scope of judicial supervision of international commercial arbitration from the point of view of procedure and entity. The third part, from the analysis of judicial supervision of international commercial arbitration in China, reveals that the judicial supervision system of international commercial arbitration in China pays too much attention to fairness at the expense of efficiency. Adopting the two-track system of domestic arbitration and foreign-related arbitration, the arbitrability matters are unclear and the re-arbitration system is not clear, and so on. On the basis of adhering to the concept of combining efficiency and fairness, this paper proposes to change the two-track system model, to perfect the relevant mechanism in procedural supervision, and to rationally arrange the arbitration system. Finally, according to the development characteristics of international commercial arbitration system in the future, the development trend of judicial supervision system of international commercial arbitration in China is prospected.
