联合国大陆架界限委员会的职责及其建议的效力

【摘要】：外大陆架界限确定问题,是近年来国际法学界关注的热点。到2009年8月10日,联合国大陆架界限委员会共计收到51个申请案,其中包括我国周边邻国日本、越南和马来西亚等国提交的申请案。此外,大陆架界限委员会还收到44个初步信息。大陆架界限委员会是根据《联合国海洋法公约》成立的机构,它作为联合国的一个独立和专门的划定外大陆架界限的机构,在各沿海国的大陆架划界事务中扮演着重要的角色。本文通过文献资料法来搜集国内外学术界对大陆架界限委员会性质的讨论,通过个案研究法来探讨了有关沿海国对其大陆架权利的主张,通过比较研究法分析了国际上普遍接受的相关大陆架划界的原则和方法,从而总结出委员会的性质及其决议的效力。大陆架界限委员会的实践其建议表明,为确保沿海申请国对有关大陆架领土享有主权权利,委员会必须有理由相信相关的陆地上不存在任何主权争议。在此基础上,委员会才能审议各沿海国提交的外大陆架划界申请案,才能针对申请案提出建议或者技术和科学咨询意见。委员会实际上是各主权国国家意志妥协而成立的产物,它所具有的权力以及职责均不能凌驾于各国的主权之上,它能且仅能在主权国家授权的范围行使其职权。
[Abstract]:The determination of the limits of the outer continental shelf has been a hot topic in the international legal community in recent years. By 10 August 2009, the United Nations Commission on the limits of the Continental Shelf had received a total of 51 applications, including Japan, a neighbouring country of our country, Applications submitted by Viet Nam and Malaysia. In addition, the Commission on the limits of the Continental Shelf received 44 preliminary information. The Commission on the limits of the Continental Shelf is a body established under the United Nations Convention on the Law of the Sea as an independent and specialized body of the United Nations for the delineation of the outer continental shelf, It plays an important role in the delimitation of the continental shelf of the coastal States. This paper collects the discussion of the nature of the Commission on the limits of the Continental Shelf in the academic circles at home and abroad through the method of literature. The claim of the coastal State to its continental shelf rights has been explored through case studies, and the internationally accepted principles and methods for the delimitation of the relevant continental shelf have been analysed through a comparative study, Thus summarizes the nature of the Commission and the effectiveness of its resolution. The practice of the Commission on the limits of the Continental Shelf indicates that, in order to ensure the sovereign rights of the coastal applicant State over the territory of the continental shelf in question, the Commission must have reason to believe that no sovereignty dispute exists on the relevant land... on that basis, In order for the Commission to consider applications submitted by coastal States for the delimitation of the outer continental shelf and to make recommendations or technical and scientific advice on such applications... the Commission is in fact the product of a compromise of the will of sovereign States, Its powers and duties are not superior to the sovereignty of States, it can and can only exercise its powers within the limits authorized by sovereign States.
