涉外网络侵权的司法管辖权问题研究

【摘要】：互联网在十几年的时间内迅速发展、席卷全球,影响了人类生活的各个方面,并且对传统的法律体制甚至法律思维方式产生了深远的影响。网络侵权,作为晚近才出现的侵权类型,由于其自身特点,在全世界范围内愈演愈烈,并且在案件管辖权方面出现了极大的争议和挑战。本文从网络侵权的概念和特点出发,分析了这种新型侵权类型对传统管辖权规则的挑战,并通过对美国、欧盟、中国关于网络侵权案件管辖权的实践以及海牙国际私法会议相关实践的分析和讨论,可以看到目前各国和国际社会在网络侵权中管辖权确定上存在很大的争议,尚无统一的做法,并且无论美国的“最低限度联系”方法和欧盟《布鲁塞尔条例》确定管辖权的模式都存在一定缺陷。最后从我国的实践出发,提出了对我国网络侵权管辖权的改进与完善的建议。
[Abstract]:The Internet has developed rapidly in more than ten years, sweeping the world, affecting all aspects of human life, and exerting a profound influence on the traditional legal system and even the mode of legal thinking. Network infringement, as a kind of infringement that appeared recently, has become more and more serious in the world because of its own characteristics, and there have been great disputes and challenges in the jurisdiction of cases. Based on the concept and characteristics of network tort, this paper analyzes the challenge of this new type of infringement to the traditional jurisdiction rules, and through the analysis of the United States, the European Union, From the analysis and discussion of China's practice of jurisdiction in network tort cases and the relevant practice of the Hague Conference on Private International Law, we can see that there are great disputes between countries and the international community on the determination of jurisdiction in network infringement. There is no uniform approach, and both the "minimum link" approach of the United States and the EU's model for determining jurisdiction are flawed. Finally, according to the practice of our country, this paper puts forward some suggestions on the improvement and perfection of the jurisdiction of network infringement in our country.
