外资银行监管法律制度研究

【摘要】：随着大量的外资银行进入我国,在利润份额方面,国内银行遭受到了一定的冲击,这就要求国内银行在服务水平和国际竞争力方面需要进一步提升和加强。外资银行在我国的银行业已经占有重要的地位。在承担了WTO义务的前提下,如何对外资银行加强监管,维护好我国的金融业以及金融秩序保持稳定,成为了一个亟需解决的重要问题,所以在此背景下研究如何对我国外资银行的监管法律制度完善有着极为重大的理论意义与现实意义。因此本文对外资银行监管的法律制度进行了研究。文章除前言之外,分为四章展开论述。在前言部分,主要说明了课题来源、研究目的和意义、国内外研究现状和发展趋势、主要研究内容和创新点等内容。第一章是对外资银行监管的概述,内容包括外资银行监管的涵义、监管外资银行的现实必要性、外资银行的监管原则等。第二章对国外外资银行之监管制度进行了论述和比较,主要内容有美国对外资银行监管的法律规定、英国对外资银行的法律监管规则、日本对外资银行监管的制度建设。第三章论述了我国对外资银行监管存在的问题,内容包括我国监管机制自身的缺陷和我国在外资银行监管的立法方面存在的弊端。其中,我国监管机制自身的缺陷包括未明确承认母国监管为主的综合监管原则；外资银行监管机构设置存在不足；监管重点模糊,风险监管力度不强；外资银行缺少自我管理机制。我国在外资银行监管的立法方面存在的弊端包括外资银行立法的价值取向不合理；现有的外资银行监管的法律法规不完善；我国立法内容与监管操作不协调。第四章是完善我国外资银行监管法律制度对策与建议,内容包括我国外资银行监管立法的完善、完善我国外资银行监管体系的具体措施、具体的监管原则及内容完善、对外资银行监管国际合作的完善等。
[Abstract]:With a large number of foreign banks entering China, the domestic banks have suffered a certain impact in the profit share, which requires the domestic banks to further enhance and strengthen the service level and international competitiveness. Foreign banks have played an important role in China's banking industry. Under the premise of assuming the obligation of WTO, how to strengthen the supervision of foreign banks and maintain the stability of our financial industry and financial order has become an important problem that needs to be solved. Therefore, it is of great theoretical and practical significance to study how to improve the supervision legal system of foreign banks in China under this background. Therefore, this paper studies the legal system of the supervision of foreign banks. In addition to the preface, the article is divided into four chapters to discuss. In the preface, it mainly explains the source of the subject, the purpose and significance of the research, the present situation and development trend of the research at home and abroad, the main research contents and innovation points and so on. The first chapter is an overview of the supervision of foreign banks, including the meaning of supervision of foreign banks, the practical necessity of supervision of foreign banks, the principles of supervision of foreign banks, and so on. The second chapter discusses and compares the supervision system of foreign banks. The main contents are the legal regulations of the United States on the supervision of foreign banks, the rules of legal supervision of foreign banks in Britain, and the construction of the supervision system of foreign banks in Japan. The third chapter discusses the problems existing in the supervision of foreign banks in our country, including the defects of the supervision mechanism and the drawbacks in the legislation of the supervision of foreign banks in our country. Among them, the defects of China's regulatory mechanism include the failure to explicitly recognize the principle of comprehensive supervision based on home country supervision; the insufficient establishment of foreign banks' regulatory bodies; the vague focus of supervision and the weak risk supervision; Foreign banks lack self-management mechanisms. The drawbacks in the legislation of foreign bank supervision in our country include the unreasonable value orientation of foreign bank legislation, the imperfect laws and regulations of foreign bank supervision, and the disharmony between the content of legislation and the supervision operation in our country. The fourth chapter is to perfect the legal system of supervision of foreign banks in China, including the improvement of the legislation of supervision of foreign banks, the specific measures to improve the supervision system of foreign banks in China, the specific principles and contents of supervision. The perfection of international cooperation in the supervision of foreign banks.
