WTO上诉机构争端解决效率拖延及原因分析

【摘要】：WTO上诉机构作为WTO争端解决机构中的常设机构,在世界经济环境瞬息万变的今天,对国际贸易争端的有效缓解和解决起到了至关重要的作用,然而,其所面临的挑战也在不断显现。其中,争端解决程序的效率拖延问题已经成为各成员方讨论的焦点,程序的拖延使WTO成员方开始寻求其他程序解决争端,很大程度上影响了WTO争端解决机制的可靠性和有效性。本文结合WTO上诉争端解决效率拖延的典型案例,剖析了其中的原因,指出了需要重视的几个问题。
[Abstract]:As a permanent body in the WTO dispute settlement body, the WTO Appellate body plays a vital role in the effective mitigation and settlement of international trade disputes in the rapidly changing world economic environment. The challenges it faces are also emerging. Among them, the efficiency procrastination of the dispute settlement procedure has become the focus of discussion among the members. The delay of the procedure makes the WTO members start to seek other procedures to resolve the dispute, which greatly affects the reliability and effectiveness of the WTO dispute settlement mechanism. Based on the typical case of WTO dispute settlement efficiency delay, this paper analyzes the reasons and points out some problems that need to be paid attention to.
