论海盗赎金及其保险赔付法律问题

【摘要】:近年来,海盗频频出现在新闻报道和世界各国的视野中。日益猖獗的海盗活动无疑使本来就处于低迷的国际运输业雪上加霜。目前海盗对劫掠船舶、抢夺货物的传统做法不再热衷,转而对扣押船舶、货物以及船员并索取赎金情有独钟。动辄成百上千万的海盗赎金,对船货双方及保险人来说,都是非常沉重的负担,由此也引起了一系列关于海盗赎金的纠纷,对此目前国际上没有统一的规定。海盗赎金问题因此也成为令学术界与保险业都感到棘手的问题。那么在理论上如何认识海盗赎金?在实践上如何操作赎金的承保赔付?处理涉及海盗赎金问题时如何对相关当事人进行权利义务的配置?这些将是本文探讨的内容和核心。 本文的正文共分为五章。第一章阐述了本文的研究目的与意义、内容与方法以及创新之处。第二章对海盗赎金进行基本概述。首先介绍海盗行为与海盗赎金的关系,引入海盗行为的定义,比较分析海盗行为造成的损失类型,得出赎金损失的特点。接着从海商法的基本理论入手,对海盗赎金的定义、合法性争议和法律性质进行探讨,认为将海盗赎金作为共同海损比较合理;第三章,对海盗风险的保险赔付进行研究。首先介绍海盗赎金与海盗风险的关系,论证海盗赎金损失属于海盗风险,进而分析现有的国内外关于承保海盗风险的法律规定;第四章通过比较论证的方法,比较国际上承保海盗赎金的现有做法,讨论我国关于海盗赎金损失支付存在的现状与困难,借鉴国际惯例,得出我国应将海盗赎金列入保险赔付范围的结论;第五章运用保险法理论,对我国海上保险立法及实践提出建议。
[Abstract]:In recent years, pirates have frequently appeared in news reports and in the vision of countries all over the world. Rampant piracy will undoubtedly add to the already depressed international transport industry. Pirates are no longer keen on hijacking ships and seizing goods, but rather have an interest in seizing ships, cargo and crew and demanding ransom. Millions of pirate ransoms are a very heavy burden on both parties and insurers, which has caused a series of disputes about pirate ransom, and there is no unified international regulation on this at present. The issue of piracy ransom has therefore become a thorny issue for both academia and the insurance industry. So, in theory, how do you know pirate ransom? How to operate the underwriting payment of ransom in practice? How do the rights and obligations of the parties concerned be allocated when dealing with the issue of piracy ransoms? These will be the content and core of this article. The text of this paper is divided into five chapters. The first chapter describes the purpose and significance of this paper, content and methods as well as innovation. The second chapter gives a basic overview of pirate ransom. Firstly, the relationship between piracy and ransom is introduced, the definition of piracy is introduced, the types of loss caused by piracy are compared and analyzed, and the characteristics of ransom loss are obtained. Then starting with the basic theory of maritime law, the definition, legitimacy dispute and legal nature of pirate ransom are discussed, and it is considered that it is more reasonable to regard pirate ransom as general average; chapter three, the study on the insurance payment of piracy risk. Firstly, it introduces the relationship between pirate ransom and piracy risk, proves that pirate ransom loss belongs to piracy risk, and then analyzes the existing domestic and foreign legal provisions on underwriting piracy risk. This paper compares the existing international practice of underwriting pirate ransom, discusses the present situation and difficulties of payment of pirate ransom loss in our country, and draws the conclusion that the pirate ransom should be included in the scope of insurance indemnity in our country by drawing lessons from international practice. Chapter five puts forward some suggestions on the legislation and practice of marine insurance in China by using the theory of insurance law.
