论国际人道法的良性化发展

【摘要】：作为现象,国际人道法的良性化发展对人类文明而言,必定是现象当中有益的一个,因为更有效的国际人道法可以抑制更多的战场上(或类似情形的场合)的非法、负面行动或行为,而国际人道法的现实表现长年都不理想。在仔细观察下,对国际人道法良性化发展的研究具有深层的意义,但也需要了解到,这一现象并不是未来的确定趋势,也许未来的国际人道法也可能是恶性的发展。在研究过程中要考虑到当中的复杂性,因为这个议题(或现象)涉及到众多的要素和细节,它们涉及于整个社会。因此,社会学以及历史研究在这一研究中都十分重要。在这篇学位论文,以系统大观理论的视野看来,要使国际人道法良性化发展,可以得到结论,表明其关键的任务是要建立一个合适、动态的利好性均势体系,以确保社会体系的良好运作,这又要通过使要素发挥有益的影响。第一部分中,笔者试图阐述与论文议题有关的几个术语的概念和性质特点,包括“战争法”、“国际人道法”、“武装冲突法”等,这对整个研究而言是基础也是重要的部分。接下来,第二部分就是阐述战争法(以及国际人道法)在历史中的演进。之后,基于第二部分的研究,笔者提出国际人道法的一个重要性质,即不可简约的复杂性,很久之前,在雷蒙·阿隆的国际关系研究中就对此有所提及。最后一部分,笔者则是试图从更多方面来对论文议题进行分析。
[Abstract]:As a phenomenon, the benign development of international humanitarian law must be beneficial to human civilization, since more effective international humanitarian law can curb the illegality of more battlefield (or similar situations), Negative actions or actions, while the reality of international humanitarian law has been unsatisfactory for many years. After careful observation, the study on the benign development of international humanitarian law is of deep significance, but it is also necessary to understand that this phenomenon is not a definite trend in the future, and that the future international humanitarian law may also be a malignant development. The complexity of the study should be taken into account because the subject (or phenomenon) involves many elements and details that affect society as a whole. Therefore, sociology and historical research are very important in this study. In this dissertation, from the perspective of system theory, to make the development of international humanitarian law benign, we can draw a conclusion that its key task is to establish an appropriate and dynamic balance of power system. To ensure the proper functioning of the social system, this, in turn, by enabling elements to play a useful role. In the first part, the author tries to explain the concepts and characteristics of several terms related to the topic of the thesis, including "Law of War", "International Humanitarian Law", "Law of Armed conflict" and so on, which is also an important part of the whole research. The second part is about the evolution of the law of war (and international humanitarian law) in history. Then, based on the study of the second part, the author puts forward an important property of international humanitarian law, that is, irreducible complexity, which was mentioned in Ramon Aron's study of international relations a long time ago. In the last part, the author tries to analyze the topic from more aspects.
