海洋权益维护的司法考量:我国海事司法管辖的依据、发展与国际法意义

【摘要】：海事司法管辖作为国家维护海洋权益的重要方式,是国际法赋予的一项基本权利。根据《联合国海洋法公约》和习惯国际法,我国在相关海域依托主权、主权权利和历史性权利享有不同的司法管辖权。近年来我国周边海域海洋权益争端频发,以司法手段保护国家主权开辟了海洋权益维护的新思路。最高人民法院已通过司法解释规定了我国在管辖海域的民事、行政和刑事海事司法管辖内容。在管辖海域内进行海事司法管辖既可以彰显国家主权,又能够强化我国所享有的主权权利和历史性权利,维护其他海洋利益,为未来我国通过谈判等合法手段解决海洋争端积累有利证据。
[Abstract]:Maritime jurisdiction, as an important way for a country to safeguard the rights and interests of the sea, is a basic right conferred by international law. According to the United Nations Convention on the Law of the Sea and customary international law, China enjoys different jurisdiction in the relevant sea areas depending on sovereignty, sovereign rights and historical rights. In recent years, maritime rights and interests disputes occur frequently in China's surrounding sea areas, and the protection of national sovereignty by judicial means has opened up a new way of safeguarding maritime rights and interests. The Supreme people's Court has stipulated the contents of civil, administrative and criminal maritime jurisdiction in the sea areas under its jurisdiction through judicial interpretation. Maritime jurisdiction in the maritime areas under its jurisdiction can not only manifest national sovereignty, but also strengthen the sovereign and historical rights enjoyed by our country, and safeguard other maritime interests. For the future China through legal means of negotiation and other legal means to accumulate favorable evidence for the settlement of maritime disputes.
