【摘要】：在联合国成立70周年之际,回顾联合国海洋法的立法与发展进程,对于构筑海洋安全秩序有重大的意义和作用。联合国对海洋法的贡献主要为,制定了日内瓦海洋法四公约和《联合国海洋法公约》及体系。它们的实施对于海洋法律秩序的构筑作出了重大贡献,但由于《联合国海洋法公约》是折中和调和的产物,其模糊性在实施过程中出现了一些不同的认识和理解,甚至对立的国家实践,同时,也出现了一些未曾预料的海洋新问题,这些均是对《联合国海洋法公约》的挑战。作为《联合国海洋法公约》的缔约国,如何依据海洋情势的发展,进一步完善中国海洋法律体系也是紧迫而重要的任务,以确保国家海洋政策实施和海洋权益的维护。
[Abstract]:On the occasion of the 70th anniversary of the founding of the United Nations, it is of great significance and function to review the legislative and developmental process of the law of the sea of the United Nations. The main contribution of the United Nations to the law of the sea is the establishment of the Geneva Convention on the Law of the Sea and the United Nations Convention on the Law of the Sea and its system. Their implementation has made a significant contribution to the construction of the legal order of the oceans, but since the United Nations Convention on the Law of the Sea is a product of compromise and reconciliation, some different understandings and understandings have emerged in the course of its implementation, Even opposing state practice, at the same time, some unexpected new problems in the oceans, these are challenges to the United Nations Convention on the Law of the Sea. As a signatory to the United Nations Convention on the Law of the Sea, it is also an urgent and important task to further improve China's marine legal system according to the development of the marine situation in order to ensure the implementation of the national ocean policy and the protection of marine rights and interests.
