欧盟法视野下运动员自由流动权利的演变

【摘要】：本文采用历史学的研究方法，分析了在博斯曼判决框架下欧盟法律与体育行业内部规则是如何进行博弈的，并在此视野下阐述了运动员自由流动权利的演变过程，为读者展示了一幅鲜为人知的历史画卷。在当今的欧盟法规则内，运动员的权益，特别是自由流动的权利是受到法律最大化保障的，体育界的内部规则是不能排除欧盟法而单独适用的。然而在20世纪欧盟成立之初，特别是在博斯曼判决产生之前，体育行业的内部规则却一直与欧盟法律出于对抗的状态，甚至占据上风。运动员自由流动的权利也历经了由不平等趋向平等地演进过程。尊重对客观历史的考察，运用理性思维对欧盟法律、政治、体育文化进行探讨和分析，并在此基础上进行反思，有针对性的摸索出社会进步，文化变迁，法律发展之间的深刻联系，揭示法律精神之所在，从中发现其当代意义，特别是在第29届北京奥运会胜利召开之后，使我们倍加珍惜中国法制进程中所取得的辉煌成就与对未来体育法制发展的期望是本文的选题价值。国内外学者从不同的角度对博斯曼判决进行了分析，本文笔者采用黄世席教授的研究视角（自由流动权利）。但又加以创新，从欧盟法与体育行业规则的博弈这一具体层面出发，通过阶段分析，案例支撑的研究方法将博斯曼判决所代表的运动员自由流动权利的演变过程完整的呈现出来。本文具体内容分为以下四个部分：第一部分引言主要叙述了本文写作之理论意义、研究方法与国内外相关研究内容；第二部分，欧盟体育行业内部规则对运动员自由流动权利一直持否定态度，直到Walrave/Koch判决，Dona判决，Heylens判决的出现才为博斯曼判决铺平了法律道路；第三部分，博斯曼判决宣告了欧盟法律在与体育行业内部规则的博弈中取得了胜利。使运动员自由流动的权利得到了法律保障，博斯曼法案也为后续相关案例提供了法理支撑；第四部分，正如王谦先生所讲，任何制度都要不断适应新环境，不断改进。博斯曼判决及由此衍生的博斯曼法案同样为博斯曼本人及欧盟体育界带来了诸多负面影响，，它并没有完全化解体育行业规则与欧盟法律的深层次矛盾。
[Abstract]:In this paper, the author uses the historical research method to analyze how the EU law and the internal rules of the sports industry play a game under the framework of Bosman judgment, and expounds the evolvement process of the athlete's right of free flow from this perspective. It shows readers a little-known picture of history. In today's EU law, the rights and interests of athletes, especially the right of free movement, are guaranteed by law maximization, and the internal rules of sports cannot be excluded and applied separately. However, at the beginning of the 20th century, especially before the Bosman decision, the internal rules of the sports industry have been in a state of confrontation with the EU law, and even gained the upper hand. The right of free movement of athletes has also undergone the process of evolution from inequality to equality. Respect for the objective history, use rational thinking to explore and analyze EU law, politics, sports culture, and on this basis, to explore the social progress and cultural changes. The deep connection between the development of law, reveals the legal spirit, finds its contemporary significance, especially after the 29th Beijing Olympic Games successfully held, It is the value of this paper to make us treasure the brilliant achievements in the process of Chinese legal system and the expectation of the development of sports legal system in the future. Scholars at home and abroad have analyzed the Bosman judgment from different angles. In this paper, the author adopts the research perspective of Professor Huang Shishi (the right of free flow). But it also innovates, starting from the specific level of the game between EU law and the rules of the sports industry, through the stage analysis, The research method of case support presents the evolution process of athlete's free flow right represented by Bosman judgment. This paper is divided into four parts: the first part of the introduction mainly describes the theoretical significance of this writing, research methods and related research at home and abroad, the second part, EU rules within the sports industry have been negative about the right to free movement of athletes until the appearance of the Walrave/Koch ruling, which paved the way for Bosman's ruling; part three. The Bosman ruling declared a victory for EU law in the game against the internal rules of the sports industry. The right to free movement of athletes is guaranteed by law, and the Bosman Act provides legal support for subsequent cases; part IV, as Mr Wang Qian said, any system must be constantly adapted to new circumstances and constantly improved. The Bosman decision and the resulting Bosman Act have also brought a lot of negative effects to Bosman himself and the EU sports world, and it has not completely resolved the deep contradiction between the rules of the sports industry and the EU law.
