金融危机背景下美国对华反倾销研究

【摘要】：自全球金融危机爆发后,美国对我国反倾销急剧增加。这些反倾销调查,相较于以往美国对华采取的反倾销措施有很大不同,呈现出十分明显的新特点:一、受贸易保护主义影响深重;二、多采用反倾销反补贴的“双反”调查;三、容易产生示范效应并引起连锁反应。本文以油井管反倾销调查一案为例进行分析,发现美国当局在对具体损害、倾销幅度、倾销与损害的因果关系认定方面等都存在问题。美国的这些反倾销调查在许多方面都违反了WTO反倾销协定的规定,这一行为滥用了贸易救济制度。金融危机以后,美国对华采取的反倾销措施越发频繁,究其原因有三:一、美国贸易保护主义在经济危机的影响下重新抬头;二、美国反倾销法存在缺陷;三、美国不承认我国市场经济地位。面对新形势下的美国对华反倾销,企业、行业协会、政府要联合起来,共同构建预警机制与应诉机制,本文提出了以下应对策略:一、充分利用WTO争端解决机制;二、加大政府监管力度;三、形成应对反倾销措施的完整体系。只有这样,才能使中国企业从整体上提高对美反倾销的应诉能力,从而才能改变我国频遇美国反倾销的局面,保护国内产业环境。
[Abstract]:Since the outbreak of the global financial crisis, the US anti-dumping against China has increased sharply. These anti-dumping investigations are quite different from the antidumping measures taken by the United States against China in the past, and show very obvious new characteristics: first, they are deeply influenced by trade protectionism; Third, it is easy to produce demonstration effect and cause chain reaction. Taking the case of oil well tube anti-dumping investigation as an example, it is found that the American authorities have some problems in the specific injury, dumping margin, the causal relationship between dumping and injury, and so on. These antidumping investigations in the United States violate the provisions of the WTO anti-dumping agreement in many respects, which abuse the trade remedy system. After the financial crisis, the anti-dumping measures taken by the United States against China became more and more frequent, for three reasons: first, the US trade protectionism rose again under the influence of the economic crisis; second, the US anti-dumping law had defects; and third, The United States does not recognize our market economy status. In the face of the new situation of American anti-dumping, enterprises, trade associations and governments to unite to build an early warning mechanism and a response mechanism, this paper puts forward the following countermeasures: first, make full use of the WTO dispute settlement mechanism; second, Strengthen government supervision; third, form a complete system to deal with anti-dumping measures. Only in this way can Chinese enterprises improve their ability to respond to anti-dumping actions against the United States as a whole, thus changing the situation of China's frequent antidumping against the United States and protecting the domestic industrial environment.
