【摘要】：本文以国家管辖豁免的例外为研究对象，，主要探讨国家管辖豁免例外的理论根据、性质、情形及其范围，列举了外国的案例来说明国家管辖豁免例外的适用情况。在国家管辖豁免例外几个情形中对涉及的案例进行了论述，并对中国的现状及其对策进行了分析。文章一共分为四个部分。第一部分是国家管辖豁免及其例外概述。一直以来，国家豁免的例外问题是国家豁免领域内的最重要和最具争议的问题，此部分对具体的涵义及内容作了简要论述。第二部分是《联合国国家及其财产豁免公约》中国家管辖豁免的例外。主要是对商业活动、雇佣合同这两种国家豁免的例外作为重点研究对象，并且简要分析了其他几种例外情形。在论述商业活动作为国家豁免的主要例外时，其论述重点是商业活动的认定以及标准。第三部分是外国关于管辖豁免例外的立法及其实践。国家豁免观念的发展主要是源于欧美诸国，尤其以英美国家最为典型。因此文中列举了美国《外国主权豁免法案》、英国《国家豁免法》；且《欧洲国家豁免公约》是迄今唯一有效的多边条约，亦列举了其中的相关规定及案例。第四部分是中国关于国家管辖豁免例外的实践及发展趋势。对中国国家管辖豁免的现状及其实践情况进行了总结，并对未来中国应采取的立场及对策提出几点建议。
[Abstract]:This article takes the exception of national jurisdiction exemption as the research object, mainly discusses the theoretical basis, the nature, the situation and the scope of the exemption of national jurisdiction, enumerates the foreign cases to illustrate the application of the exemption of the national jurisdiction exemption. The cases are discussed in the exceptions of the exemption of national jurisdiction, and the present situation of China is presented. And its countermeasures are analyzed. The article is divided into four parts.
The first part is the summary of the exemption of national jurisdiction and its exceptions. The exception of the state immunity has been the most important and most controversial issue in the field of state immunity, and this part gives a brief discussion on the specific meaning and content.
The second part is the exception of the Chinese jurisdictional exemption of the United Nations country and its property exemption convention. It mainly focuses on the exception of the two state immunity exceptions to commercial activities and employment contracts, and briefly analyzes several other exceptions. The emphasis is on the emphasis of the exposition of commercial activities as the main exceptions to national immunity. It is the identification and standard of business activities.
The third part is the legislation and practice of foreign jurisdictional exemption exceptions. The development of the concept of state immunity is mainly derived from the European and American countries, especially in the United States and the United States. Therefore, the United States "Foreign Sovereign Immunity Act >, the national exemption law of the United Kingdom, and the European exemption Convention are the only effective multilateral article to date." The relevant provisions and cases are also listed.
The fourth part is the practice and development trend of the exemption of national jurisdiction, summarizes the current situation and practice of China's national jurisdiction exemption, and puts forward some suggestions on the position and countermeasures that China should take in the future.
