试论TPP劳工标准、其影响及中国的应对策略

【摘要】:2016年2月4日,TPP协定由12个成员国正式签署,目前正处于批准阶段。TPP劳工标准的最大特征是具有可强制执行力,适用磋商基础上的强制性争端解决机制,以贸易制裁或经济制裁为后盾,这意味着任何劳工争端最终都会延伸为贸易纠纷问题。虽然中国尚未加入TPP,但TPP劳工标准实施后的扩大适用给我国带来的负面影响应引起我国高度重视并应分别在微观、中观和宏观层面上采取应对措施,以防患于未然、更好地保护我国经济和贸易利益。
[Abstract]:The TPP agreement, which was formally signed by 12 member States on 4 February 2016, is in the process of being ratified. The greatest feature of the TPP labour standard is that it is enforceable and applies a compulsory dispute settlement mechanism based on consultations. Backed by trade or economic sanctions, any labor dispute will eventually extend to trade disputes. Although China is not yet a member of the TPPP, the negative impact of the expanded application of the TPP labor standards on China should be highly valued and countermeasures should be taken at the micro, meso and macro levels, respectively, in order to prevent trouble from happening in the first place. Better protect China's economic and trade interests.
