多边贸易体制下区域贸易协定的发展

【摘要】：自20世纪90年代以来,区域贸易协定呈现蓬勃发展的趋势。截至2010年7月31日,已经通报GATT/WTO的区域贸易协定达到474个。其中有351个基于GATT第24条缔结,31个基于授权条款缔结,92个基于GATS第5条缔结。除了蒙古国之外,其他所有WTO成员都隶属于一个或多个区域贸易协定。区域内贸易总量占国际贸易总量的比重已超过50%。区域经济一体化作为最惠国待遇原则最重要的例外,其目的在于在不增加非缔约方贸易壁垒的前提下,促进区域内贸易自由化。区域贸易协定的迅猛发展对多边贸易体制意味着什么?它到底是多边贸易体制的绊脚石还是垫脚石?协调区域贸易协定与多边贸易体制之间的关系,对于WTO的长远发展至关重要。自中国正式加入世界贸易组织以来,中国在坚持多边贸易体制的基础上,积极参与区域经济一体化。目前,中国正与31个国家和地区建设14个自贸区,签署自贸协定8个。2011年是十二五开局之年,也是中国加入世贸组织十周年。在这一关键年份,总结中国过去参与区域贸易组织的成功经验,对于中国未来的经济发展意义重大。本文分四章进行阐述: 第一章“区域贸易协定概述”介绍了区域贸易协定的概念和类型,分析了区域贸易协定蓬勃发展的经济原因、政治原因和其他原因,并归纳了区域贸易协定的发展趋势; 第二章“GATT/WTO对区域贸易协定的法律规制”着重阐述了多边贸易体制关于区域贸易协定的法律规范,主要涉及GATT第24条、《关于解释1994年GATT第24条的谅解》、1979年“授权条款”、GATS第5条,阐述了多边贸易体制对区域贸易协定的审议机制,并介绍了《区域贸易协定透明度机制》的内容; 第三章“区域贸易协定与多边贸易体制的关系”回顾了多哈回合下区域贸易协定与多边贸易体制关系的探讨,分析了区域贸易协定对多边贸易体制的积极影响和消极影响,并提出区域贸易协定与多边贸易体制冲突的解决方法; 第四章“中国参与区域经济一体化的战略选择”总结了我国参与区域经济一体化的战略演变过程,具体介绍了我国已签署的区域贸易协定。在此基础之上,提出我国参与区域经济一体化的发展重点和策略,以期对推动我国区域经贸合作有所助益。
[Abstract]:Since the 1990 s, regional trade agreements (RTAs) have been developing vigorously. As of July 31, 2010, the number of RTAs notified GATT / WTO reached 474. Of these, 351 were concluded under Article XXIV of GATT, 31 were concluded on the basis of authorization clauses and 92 were concluded under Article V of GATS. All WTO members except Mongolia are subject to one or more RTAs. The share of total intraregional trade in total international trade has exceeded 50%. As the most important exception to the most-favoured-nation treatment principle, regional economic integration aims at promoting intraregional trade liberalization without increasing non-party trade barriers. What does the rapid development of RTAs mean for the multilateral trading system? Is it a stumbling block or a stepping stone to the multilateral trading system? To coordinate the relationship between RTAs and the multilateral trading system is very important for the long-term development of WTO. Since China's entry into WTO, China has actively participated in regional economic integration on the basis of multilateral trading system. At present, China is building 14 free trade zones with 31 countries and regions and signing 8 free trade agreements. 2011 is the opening year of the 12th Five-Year Plan and the 10th anniversary of China's accession to the WTO. In this critical year, summing up China's successful experience in participating in regional trade organizations in the past is of great significance to China's economic development in the future. This paper is divided into four chapters: the first chapter "Overview of regional trade agreements" introduces the concept and types of regional trade agreements, analyzes the economic reasons, political reasons and other reasons for the vigorous development of regional trade agreements. The second chapter, "the legal regulation of RTAs by GATT / WTO", focuses on the legal norms of RTAs in the multilateral trading system. Relating primarily to Article XXIV of the GATT, the understanding on the interpretation of Article XXIV of GATT 1994, the enabling provisions of 1979 and Article V of the GATS, which set out the mechanism for the review of regional trade agreements in the multilateral trading system, The third chapter, "the relationship between regional trade agreements and the multilateral trading system", reviews the relationship between regional trade agreements and the multilateral trading system under the Doha Round, Having analysed the positive and negative effects of regional trade agreements on the multilateral trading system, The fourth chapter, "Strategic Choice of China's participation in Regional Economic Integration", summarizes the strategic evolution of China's participation in regional economic integration. This paper introduces the regional trade agreement that our country has signed. On this basis, this paper puts forward the development focus and strategy of China's participation in regional economic integration, in order to promote regional economic and trade cooperation in China.
