国际货币壁垒之法律视角研究

【摘要】：国际货币壁垒是在2008年全球经济危机爆发后，以美国为首的发达国家为了抑制对华贸易逆差的持续扩大，而利用美元的优势地位，单方采取的以货币币值的变动，影响正常的国际贸易秩序的新型壁垒手段。由于借助了货币这一特殊媒介，使得该种壁垒模式较之于传统贸易壁垒而言，在实施上更为隐蔽，影响范围更广，程度更深。并且随着国际经济局势的不断变化，这种新型壁垒模式的作用得到了空前发挥，未来货币壁垒必将成为国际贸易壁垒中一个非常重要的贸易保护主义措施。然而即便如此，国际社会对于这种新近出现的贸易壁垒仍未予以足够的重视。加之国际货币壁垒跨越的学科领域较广，不仅涉及金融领域、政治领域、法律领域，有时还会牵涉到国家安全问题。因此，国际货币壁垒比传统贸易壁垒更加复杂，这也注定了此类学术研究的难度之大。鉴于上述原因，国内外针对与该问题有关的学术研究长期止步于外汇管制方面，对于当前出现的新型壁垒方式始终无人问津。而笔者本次的大胆尝试，也正是希望能够开启此类问题的研究先河，启发后来者进行更加全面、深入、系统的研究，填补相关理论空白。本文论述共分为五个部分：开篇导言部分对文章的选题、研究意义、研究方法及思路等方面进行概括性陈述。紧接着，笔者在第二部分对国际货币壁垒问题的国内外研究状况进行了归纳总结。通过研究笔者发现，至今为止世界范围内对于新型货币壁垒的学术研究尚处于真空状态。国际层面上对货币壁垒概念界定仅限于传统的政府外汇管制措施，对于新型的货币壁垒则仅有个别新闻媒体在报导中提及过，而在我国境内，则尚未有人公开使用过“货币壁垒”的提法。鉴于此种情况，笔者在对当前货币壁垒的特点及表现形式进行了深入分析的基础上，于第三部分尝试性地为该种贸易壁垒定义，并首次提出将货币壁垒分为广义和狭义两种类别予以研究。继而通过对货币壁垒与近似概念之间的辨析，以及该壁垒的实施对国家货币主权的影响研究，令货币壁垒的理论体系研究更加完整。之后在本文第四部分，笔者通过对货币壁垒作用下三类国际贸易数据变化的解析，得出技术贸易以及与之相关的服务贸易是受货币壁垒影响最小的贸易类别的结论。除此之外，各国国情的差异也是影响国际货币壁垒发挥作用的重要因素之一。最后，在国际货币壁垒的应对方面，笔者从国际和国内两个层面为之提出了政策和法律途径。如通过重构国际货币体系，改革国际贸易体系和完善国际法律体系的三方面措施，在国际层面上形成联合防控系统，，消除货币壁垒产生的外部条件。在国内则通过加快经济体制改革，产业结构调整，从根本上去除货币壁垒的形成诱因；完善金融监管的法律制度，防控因货币壁垒而引发的热钱冲击。此外，还要特别重视与国际社会的沟通与合作，借助国际社会的力量，共同应对国际货币壁垒。
[Abstract]:After the global economic crisis broke out in 2008, the developed countries, led by the United States, have made use of the dominant position of the United States dollar in order to suppress the trade deficit in China, and take the change in the monetary value of the currency unilaterally to affect the normal international trade order. Compared with the traditional trade barriers, this kind of barrier model is more hidden in implementation, wider and deeper. And with the continuous change of the international economic situation, the role of this new barrier model has been played an unprecedented role, and the future monetary barrier will become a very important trade barrier in the international trade. However, even so, the international community has not paid enough attention to this newly emerging trade barrier. In addition to the wider field of international monetary barriers, it involves not only financial, political, legal, but also national security issues. Therefore, international monetary barriers are more than traditional trade barriers. In view of the above reasons, the academic research related to the problem at home and abroad has been closed to foreign exchange control for a long time, and the current new type of barriers has always been ignored. And the author's bold attempt is hoping to open such a question. The study of the problem first inspired the later to conduct a more comprehensive, in-depth and systematic study to fill gaps in relevant theories.
This article is divided into five parts: the beginning of the introduction to the topic of the article, research significance, research methods and ideas and other aspects of the general statement. Then, the author in the second part of the international monetary barriers to the domestic and foreign research status of the summary. The academic research on the new type of monetary barrier is still in a vacuum state. The definition of the concept of currency barriers is limited to the traditional government foreign exchange control measures at the international level. Only a few news media have mentioned the new monetary barriers in the report, while in our country, no one has publicly used the "currency barrier". In this case, on the basis of in-depth analysis of the characteristics and manifestations of current monetary barriers, the author tries to define the trade barriers in the third part, and first proposes to divide the currency barriers into two categories in a broad and narrow sense, and then through the discrimination between the monetary barriers and the approximate concepts, and The study of the impact of the implementation of the barrier on national monetary sovereignty makes the theoretical system of monetary barriers more complete. Then in the fourth part of this paper, the author analyses the changes in the three types of international trade data under the role of monetary barriers, and concludes that technical trade and related services trade are the least affected by monetary barriers. In addition, the differences in national conditions are also one of the important factors that affect the role of international monetary barriers. Finally, the author puts forward policy and legal approaches to the international and domestic two aspects of the international monetary barriers, such as the reform of the international monetary system, the reform of the international trade system and the improvement of the international trade system. The three aspects of the international legal system have formed a joint prevention and control system at the international level to eliminate the external conditions of the monetary barriers. In China, the incentives for the formation of monetary barriers are fundamentally removed by accelerating the reform of the economic system and the adjustment of the industrial structure; the legal system of financial supervision and control is perfected to prevent and control the monetary barriers. In addition, we should also pay special attention to communication and cooperation with the international community and jointly cope with international monetary barriers with the help of the international community.
