国际产品责任惩罚性赔偿冲突法的实体正义研究

【摘要】：国际产品责任惩罚性赔偿的冲突规范应以冲突正义为基础,不断融入实体正义。国际产品责任惩罚性赔偿冲突规范所应重点体现的价值取向有:被侵权人得到迅速合理的赔偿、惩罚与遏制功能的实现、法院地国的利益、保障交易利益、当事人的正当期望与准据法的可预见性、世界经济协调发展。国际产品责任惩罚性赔偿的冲突规范有别于国际产品责任的冲突规范,立法上应当通过保护弱者原则、双重可诉原则、排除被告不可预见原则等方面体现出其特殊性。
[Abstract]:The conflict norms of punitive damages for international product liability should be based on conflict justice and be integrated into substantive justice. The value orientation of the conflict norm of punitive damages for international product liability should be embodied as follows: the infringed party gets prompt and reasonable compensation, the realization of punishment and containment function, the interests of the forum country, and the protection of the transaction interest. The legitimate expectations of the parties and the predictability of applicable law make the world economy develop harmoniously. The conflict norm of punitive damages of international product liability is different from the conflict norm of international product liability. The legislation should embody its particularity through the principle of protecting the weak, the principle of double actionable, the principle of excluding the unforeseeable defendant and so on.
