欧盟反吸收法律制度研究及我国的应对

【摘要】：欧盟的反倾销法是目前世界上最全面最完备的反倾销法,其中规定的反吸收法律制度是目前独一无二的,是十分有特色的一项法律制度。这项制度作为反倾销法律制度的延伸,保障了采取反倾销措施的效果。到目前为止只有欧盟对反吸收法律制度做了详尽的规定,其他国家的立法在反吸收法律制度方面仍然是空白,我国也是如此。而近年来欧盟对我国的反吸收调查越来越频繁,研究欧盟的反吸收法律制度可以为我国防止和应对反吸收提供借鉴。本文揭示了反吸收法律制度的特点,分析了其优点和滥用反吸收调查的后果。从立案、调查和调查结果三方面分析欧盟反吸收法律制度的实体性和程序性规定。分析我国面临的严峻形势和频遭反吸收调查的原因,在此基础上从政府、企业、行业协会三方面入手提出应对欧盟反吸收调查的对策。本文主要运用了以下研究方法：第一,文献研究的方法。本文在分析反吸收法律制度时,阅读并翻译了历年来欧盟对反吸收法律制度的规定,翻阅相关文献,深入研究该制度的特点。第二,比较研究方法,在分析反吸收法律制度时,与其他近似地法律制度进行比较,更加深入的剖析其本质。反吸收法律制度作为一项先进的制度,在贸易保护愈演愈烈的情况下,必然会为越来越多的国家采用。所以我国必须深入研究欧盟的反吸收法律制度,本文在分析的前提下提出了有针对性的对策,避免我国企业在应对反吸收调查时措手不及,使我国企业在应诉时能有备无患,在反吸收诉讼中获得较好的结果,进而保护国内相关产业在国际市场上的份额,维护我国利益。
[Abstract]:EU antidumping law is the most comprehensive and complete antidumping law in the world at present. As an extension of anti-dumping legal system, this system guarantees the effect of anti-dumping measures. Up to now, only the EU has made detailed provisions on the anti-absorption legal system, and the legislation of other countries is still blank in the aspect of anti-absorption legal system, and so is our country. In recent years, the EU has made more and more investigations on China's backabsorption, so the study of EU's anti-absorption legal system can provide a reference for our country to prevent and deal with the anti-absorption. This paper reveals the characteristics of the reverse absorption legal system, analyzes its advantages and the consequences of abuse of the reverse absorption investigation. This paper analyzes the substantive and procedural provisions of the EU's anti-absorption legal system from three aspects: filing, investigation and investigation results. Based on the analysis of the severe situation faced by China and the reasons for the frequent backabsorption investigation, the countermeasures to deal with the EU anti-absorption investigation are put forward from three aspects: government, enterprises and trade associations. This article mainly uses the following research methods: first, the literature research method. In the analysis of the reverse absorption legal system, this paper read and translated the European Union's regulations on the reverse absorption legal system over the years, looked through the relevant literature, and studied the characteristics of the system in depth. Second, the comparative research methods, in the analysis of the reverse absorption of the legal system, compared with other similar legal systems, more in-depth analysis of its essence. As an advanced system, the anti-absorption legal system will be adopted by more and more countries. Therefore, our country must deeply study the EU's anti-absorption legal system. This paper puts forward targeted countermeasures under the premise of analysis, so as to avoid our enterprises being caught off guard when dealing with counter-absorption investigations, so that our enterprises can be prepared and free from trouble when responding to lawsuits. Better results can be obtained in the counterabsorption litigation, thus protecting the share of domestic related industries in the international market and safeguarding the interests of our country.
