揭开人事外包的面纱:论劳务派遣之实质审查

【摘要】:劳务派遣的法律规制在《劳动合同法》起草、制定和修改的历史进程中逐渐收紧,劳务派遣反而呈现出一派"逆市繁荣"的景象。究其根本,大量的劳务派遣借用人事外包的名义企图混淆视听,规避应有的法律规制,在事实上架空了法律条文的规定,直接造成了劳务派遣越管越多、越管越乱的失控局面。本文立足比较法的研究方法,论证和肯定了劳务派遣存在的价值,剖析归纳了劳务派遣存在的类型,针对借人事外包之名、行劳务派遣之实的现象,指出劳务派遣实质审查的缺失是造成这一现象的根本原因,建议通过确立和完善劳务派遣实质审查来根治劳务派遣过度泛滥的顽疾。
[Abstract]:The legal regulation of labor dispatch is gradually tightened in the historical process of drafting, formulation and revision of Labor contract Law. Instead, labor dispatch presents a scene of "prosperity against the market". A large number of labor dispatch to borrow the name of personnel outsourcing attempts to confuse the public, circumvent due legal regulation, in fact, the provisions of the legal provisions, directly resulting in more and more labor dispatch. Based on the comparative method, this paper demonstrates and affirms the value of the existence of labor dispatch, analyzes and summarizes the types of labor dispatch existence, aiming at the name of personnel outsourcing. This paper points out that the lack of substantive examination of labor dispatch is the fundamental cause of this phenomenon, and suggests that the persistent disease of excessive overflowing of labor dispatch should be cured by establishing and perfecting the substantive examination of labor dispatch.
