农电用工安全责任的风险防控研究

【摘要】:为满足不断增长的供电服务需求,供电企业从节约用工成本和防范用工风险出发,一种独立于供电企业内部正式员工的劳动群体在农网建设和维护中应运而生,这个劳动群体就是现实常说的农电工。大量涌现的农电工一方面使得供电企业内部日益增长的工作总量与正式劳动用工补充不足之间的矛盾得以缓和,突发电力系统运行故障的处理周期大幅度缩短,有效地保障了电能的正常供应;另一方面,也节约了大量的用工成本,降低了供电企业经营负担。与此同时,由于农电工一般缺乏正规、完善的职业技能培训和安全防范意识,加之农村配网环境复杂,由此引发的农电工自身安全责任事故与法律纠纷时有发生,更有因突发事故处理不当而侵犯第三人人身权利的重大安全责任事故产生,不仅严重影响社会和谐稳定以及供电企业的正常经营,也干扰了城乡“同网同价”工作的顺利进行。故而,可以说农电用工是一柄双刃剑,在缓解急剧增长的用工需求与供电企业内部劳动力不足之间的矛盾的同时,也带来了较多的安全责任风险,给供电企业的正常经营造成了一定的障碍。 《劳动合同法》及《劳动合同法实施条例》的出台,对我国企业用工规范提出了更高、更严的要求。在此情形下开展对农电用工安全责任风险防控研究,对平衡农电工利益与供电企业节约成本、防范安全责任风险之间的关系,并切实充分发挥发挥农电工的优势、保障农电工合法权益、防范供电企业安全责任风险,无疑具有重大的理论和现实意义。 本文除绪论和结语外共分为三个部分: 第一部分,现行农电用工模式安全责任风险。在农电体制改革的大背景下,供电企业以及各地供电企业本着精简人员、节约成本的原则,结合自身实际就农电业务以及农电工分别采取了劳务派遣和业务委托两种用工和管理方式。在劳务派遣模式中,农电工、供电企业、派遣单位三者之间的关系简要概括可以表述为“有关系没劳动,有劳动没关系”。在业务委托模式中,劳动者并不直接与供电企业发生关系,劳动者基于与受托人的劳动关系在受托人的安排下完成供电企业委托的事务,供电企业与受托方建立的是民事委托关系。最后,该部分还以部门法为标准对供电企业农电用工安全责任风险类型进行了简要论述。 第二部分,现行农电用工模式风险防控存在的主要问题。在现行农电用工模式中,劳务派遣模式主要存在以下三个问题:在诸多岗位不加区分地使用劳务派遣人员与劳动合同法规定的劳务派遣适用范围上存在冲突;供电企业自设劳务派遣公司向自身派遣劳动者的操作方式与劳动合同法规定的用人单位不得自设劳务派遣公司向自身派遣劳动者的立法精神相违背;被派遣劳动者无法实现与正式员工同工同酬的问题。相比而言,业务委托模式则存在以下几个问题:业务委托的范围无法确定;受托人往往与供电企业存在关联关系,涉嫌滥用市场支配地位;对受托人无法进行严密监管,容易导致安全责任风险。 第三部分,农电业务用工安全责任风险防控的制度完善。针对现行两种用工模式存在的主要问题,笔者认为供电企业应首先从专业技能要求、利益大小、是否核心业务以及安全责任事故发生几率等方面对目标农电业务进行全面衡量或评估,在此基础上确定两种用工模式的取舍。在采用劳务派遣模式过程中,应依法理清农电业务的劳务派遣问题,彻底改变供电企业通过自己的多经企业出资设立劳务公司而向自己派遣人员的行为;在业务委托模式中,尚需明确界定业务委托的范围、理清供电企业与外包公司的关联关系等。不论采取何种模式,供电企业均应注重农电工利益的保护。 本文可能的创新之处主要体现在:第一,通过实地调研,充分利用相关资源,获取全国有代表性的供电企业及建筑企业相关信息及材料为本文提供了坚实的实践基础;第二,通过比较劳务派遣和业务委托这两种不同的农电用工模式的不足之处,并在此基础上提出一种较为完善农电用工模式建议。本文的不足在于,因我国农电业务的现状是点多、线长、面广,这一现状决定了本文所需数据的收集难度很大,加之专门文献缺乏,导致本文可能无法全面分析我国农电用工安全责任风险现状。

The emergence of a large number of agricultural electrician makes the power supply enterprise total the work of growing and the contradictions between the formal labor supplement can be mitigated, processing cycle greatly shorten the operation of burst fault in power system, effectively guarantee the normal supply of electric energy; on the other hand, but also saves a lot of labor costs, reduce the operating burden of power supply enterprises. At the same time, due to the general lack of rural electrician regular, perfect occupation skill training and security awareness, combined with the complexity of rural distribution network environment, the agricultural safety electrician responsibility Any accidents and legal disputes have occurred, caused serious safety accidents due to improper handling and more accidents infringe the personal rights of third, not only seriously affect social harmony and stability and the normal operation of power supply enterprises, but also interfere with the urban and rural "Tongwangtongjia" work smoothly. Therefore, it can be said to be a rural labor a double-edged sword, to alleviate the internal contradictions between labor demand and supply enterprises increasing problems at the same time, also brought more responsibility for security risks, caused some obstacles to the normal operation of the power supply enterprise.
Regulations promulgated to implement the labor contract law > and < Labor Contract Law, the enterprises of our country employment norms put forward higher and more stringent requirements. In this case to carry on the employment of rural power safety responsibility risk prevention and control research on the balance of interests and rural electric power supply enterprises to save cost, prevent the security relationship between total liability risk, and to give full play to play Electrecian's advantage, protect the legitimate rights and interests of rural electrician, prevention of power supply enterprise safety responsibility risk, is undoubtedly of great theoretical and practical significance.
In addition to the introduction and conclusion, this article is divided into three parts.
The first part, the current mode of employment of rural power safety risk responsibility. In the background of rural power system reform, power supply enterprises and local power supply enterprises in the streamlined, cost saving principle, combined with their own actual net business and agricultural electrician adopted labor dispatch and business commissioned two kinds of employment and management. In labor dispatch mode, an electrician, power supply enterprises, the relationship between the three dispatch unit summary can be described as "have no labor, labor, never mind." in the business delegate pattern, laborer is not directly associated with the power supply enterprise relationship, employee and trustee of the labor relations based on the trustee under the arrangement of power supply enterprises the transaction, the power supply enterprise and the trustee is a civil principal-agent relationship. Finally, this part also takes the law department as the standard of power supply enterprise employment of rural power safety responsibility The type of risk is briefly discussed.
The second part, the main problems existing in rural employment model of risk control. In the current employment of rural power mode, labor dispatch mode mainly has the following three problems: in many post indiscriminate use of labor dispatch personnel regulations and labor contract law in the labor dispatch on the scope of conflict; power supply enterprises set up regulations of labor dispatch the company sent workers to their own mode of operation and the labor contract law, the employer shall not set up the spirit of the legislation of labor dispatch company to dispatch workers to their violation; the dispatched workers cannot be achieved with regular employees. Equal pay for equal work compared with the business delegate pattern has the following problems: the business scope of authorization cannot determine the trustee; people often have relationship with the power supply enterprise, alleged abuse of a dominant market position of the trustee can not be strict; Supervision is easy to lead to security responsibility risk.
The third part, improve the rural labor service safety responsibility risk prevention and control system. Aiming at the problems existing in the two kinds of employment patterns, the author thinks that the power supply enterprises should first from professional skill requirements, the size of the core business and interests, whether safety responsibility accident to conduct a comprehensive measure or assessment of business risk and other aspects of rural power, on the basis of determining two kinds of labor mode choice. In the use of the labor dispatch mode in the process, we should make the rural business according to law of labor dispatch, completely change the power supply enterprises through their own diversified enterprises funded the establishment of labor service company and dispatched personnel to their behavior; in the business delegate pattern, still need to clearly define the business scope of authorization, sort out the power supply enterprise and the outsourcing company's relationship. No matter what mode, the power supply enterprise shall pay attention to protect the interests of electricians.
The possible innovation of this paper is mainly reflected in: first, through field research, make full use of resources, access to national provides the solid foundation of the practice of relevant information and materials of power supply enterprises and construction enterprises in this paper; second, through the comparison of deficiencies of labor dispatch and business delegate of the two different rural labor mode and on this basis, put forward a comparatively perfect rural employment pattern. The deficiency is, because of current situation of rural power business in China is much, long, wide, this situation determines the required data collection is very difficult, and the lack of specific documents, this may not lead to a comprehensive analysis of our country employment of rural power safety risk responsibility of the status quo.
