违约责任与侵权责任竞合研究

【摘要】： 法律的规定是抽象的,要人为地对人类社会生活从不同角度不同方面予以规制,这就使同一事实出现被数个法律所规范的现象,同时可以适用数个法律规范,符合数个责任构成要件,责任竞合由此而产生,违约责任与侵权责任竞合便是最常见的一种。《中华人民共和国合同法》第一百二十二条确认了责任竞合制度,赋予了当事人以选择的权利,有利于保护当事人的合法权益。本篇论文着重论述了违约责任与侵权责任竞合的基本内涵、竞合成因、理论学说、处理模式、责任竞合在我国的适用及其选择比较,详细论证了第三人侵权、加害给付中的违约责任与侵权责任竞合。笔者提出了“补充诉讼制度”以解决竞合选择固有的缺陷,引入了矛盾分析方法展开责任竞合研究。
[Abstract]:The provisions of the law are abstract and should be artificially regulated from different angles and different aspects of human social life. This makes the same fact appear to be regulated by several laws, and several legal norms can be applied at the same time. In accordance with several constitutive requirements of liability, the concurrence of liability is the most common one. Article 122th of contract Law of the people's Republic of China confirms the system of liability concurrence. This paper mainly discusses the basic connotation, the cause of concurrence, the theory and the mode of dealing with the concurrence of the liability for breach of contract and the liability for tort, which gives the parties the right to choose, and is beneficial to the protection of the legitimate rights and interests of the parties. Comparing the application and selection of liability concurrence in our country, the author demonstrates in detail the concurrence of the liability for breach of contract and tort liability in the tort of the third party, and the author puts forward the "supplementary litigation system" to solve the inherent defects of the competing choice. The contradiction analysis method is introduced to carry out the research on the concurrence of responsibilities.
