航空客运中航班延误若干法律问题研究

【摘要】:由于其具有的便捷性、高效性,航空运输获得了人们的青睐。但是,航班延误的出现却使得这种优越性大大折扣,为人们所诟病。自1929年《华沙公约》中首次出现“延误”一词以来,国内外学者对于这一概念的争议就没有停止过,至今仍然没有形成一个统一的、为人们统一遵守的概念,这也严重影响了相关的立法进程,特别是在我国,受到传统的对民航业发展进行保护的立法保守思想的影响,我国关于航班延误的立法存在明显的滞后,这不仅对旅客的权益造成影响,也不利于航空运输业在竞争日益激烈的环境中生存和发展。另外一个方面,现实中不断增加的由于航班延误引发的旅客过激行为也对航班延误的有关立法和司法提出了新的挑战。 航空运输合同,从本质上来讲,实际上是存在于承运人、旅客或者托运人之间的一种运输合同关系。航班延误的本质是运输合同履行中出现的合同违约情形。本文运用了传统民法,特别是合同法的有关理论,结合国际和国内关于航空运输的专门法律规定,主要针对我国的航空运输中存在的航班延误问题进行了论述。本文由五个部分构成: 第一部分主要介绍了航班延误界定与判断,其中包括:国际条约中关于航班延误的界定,我国关于航班延误的界定,航班延误概念的法学解释。因此,对航班延误应当界定为:航班超过正常离站时间未起飞,或者超过正常时间未到达,,且对正常时间的界定应当进行合理的规定。 第二部分对造成航班延误的原因进行了考察,认为主要包括:天气原因、航空管制原因、航空公司原因、旅客方面的原因、机场方面的原因。并且对相关的立法和规范中规定的航班延误原因进行了考察。 第三部分是介绍我国现行立法有关航班延误产生民事责任的规定,介绍了我国主要的几部关于航班延误进行调整的法律法规中对于该问题的规定。 第四部分对我国当前的司法实践进行了考察,通过对典型案例的分析,发现航班延误责任认定中存在的困难,并对现行的司法审判实践进行评析。 第五部分对当前立法和司法实践中存在的问题进行分析,并提出相关的立法完善措施和建议,达到有法可依和定纷止争的效果。
[Abstract]:Because of its convenience and efficiency, air transportation has been favored by people. However, the appearance of flight delay has greatly reduced this advantage. Since the term "delay" appeared for the first time in the Warsaw Convention in 1929, the controversy over this concept has not stopped at home and abroad, and has not yet formed a unified, unified concept to be adhered to by people. This has also seriously affected the relevant legislative process, especially in our country, affected by the traditional conservative thinking of legislation to protect the development of the civil aviation industry, and the legislation on flight delay in our country is obviously lagging behind. This not only has an impact on the rights and interests of passengers, but also is not conducive to the survival and development of the air transport industry in an increasingly competitive environment. The increasing excesses of passengers caused by flight delay in reality also pose a new challenge to the legislation and judicature of flight delay. The air transport contract, in essence, actually exists with the carrier, A contract of carriage relationship between passengers or shippers. The essence of flight delay is the breach of contract in the performance of the contract of carriage. Combined with the international and domestic laws and regulations on air transport, this paper mainly discusses the problem of flight delay in China's air transport. This paper consists of five parts:. The first part mainly introduces the definition and judgment of flight delay, including: the definition of flight delay in international treaties, the definition of flight delay in our country, the legal interpretation of the concept of flight delay. The delay of flight should be defined as that the flight has not taken off beyond the normal departure time or has not arrived beyond the normal time, and the definition of the normal time should be reasonably stipulated. The second part investigates the causes of flight delay, which mainly include: weather reasons, aviation control reasons, airline reasons, passenger reasons, Airport reasons. And the relevant legislation and regulations stipulated in the reasons for flight delays were investigated. The third part is to introduce the current legislation of our country about the provisions of civil liability arising from flight delay, introduced the main parts of our country on the adjustment of flight delay laws and regulations on this issue. The 4th part investigates the current judicial practice of our country, through the analysis of the typical cases, finds the difficulties in the identification of flight delay responsibility, and evaluates the current judicial practice. Part 5th analyzes the problems existing in the current legislation and judicial practice, and puts forward relevant legislative improvement measures and suggestions to achieve the effect of having laws to abide by and resolving disputes.
