B-C网络交易消费者权益保护问题研究

【摘要】:网络交易作为一种新兴的交易方式,在推动经济发展的同时,也对消费者权益的保障提出了巨大的挑战。在网络这个虚拟的环境中,消费者的弱势地位相当明显,如何有效的保障网络交易消费者的权益是一个迫切的法律问题。20年前,一部《消费者权益保护法》为广大消费者撑起法律的保护伞。而如今,随着时代的变迁,人们的消费习惯、消费模式产生了巨大的变化,《消费者权益保护法》的一些规定开始慢慢落后于时代,而目前我国对消费者权益保护的主要规则被规定在该法中,其它的保护规则散见于《民法通则》、《合同法》、《反不正当竞争法》等法律法规之中,但是无论怎么看,这些法律都没有考虑网络交易的特点,并针对网络交易中的消费者权益保护问题做出特别规定,使消费者的保护范围狭窄且力度极弱。 网络交易与传统交易有相似点,也有明显的不同,本文以界定网络消费者为切入点,从分析网络消费者应有的权益入手,结合国外电子商务立法的现状、我国网络消费者权益保护的实际状况等,笔者认为应该一方面在已有的法律制度下对网络交易消费者加强保护,另一方面应该建立新的法律制度去保护消费者权益,本文分四个部分对网络交易消费者权益保护进行探讨。 第一部分对网络交易中的消费者应有的权益进行叙述,为作者之后的论述奠定基础,此部分通过阐述网络交易的概念、类型和特点,,并结合传统交易中的消费者的比较,得出消费者应有的权益范围。 第二部分针对已有的消费者权益保护制度进行分析,认为已有的制度在两个方面存在不足,分别是消费者的知情权和公平交易权的保护不足,因此有必要分别对经营者的信息披露和格式合同做出规定。 第三部分针对我国已有的法律制度的不健全,笔者认为应该引入几项新的制度以增强网络交易消费者的合法权益,分别是撤销权制度、消费者住所地诉讼管辖制度、经营者承担在途风险的制度,这三项制度是对国外制度的引进或修改。 第四部分认为网络交易消费者权益保护问题,不应仅局限于立法、司法的保护,还应该通过网络自身所在的特性,利用网络来保护消费者的合法权益,如利用网络建立监督机构、投诉处理中心、在线纠纷解决机制、网络信用评价机制。
[Abstract]:As a new way of transaction, network transaction not only promotes the development of economy, but also challenges the protection of consumers' rights and interests. In the virtual environment of network, the weak position of consumers is quite obvious. How to effectively protect the rights and interests of consumers in online transactions is an urgent legal problem. Twenty years ago, a "Consumer Rights and interests Protection Law" for the majority of consumers to support the legal umbrella. But now, with the change of times, People's consumption habits and consumption patterns have undergone tremendous changes. Some provisions of the Consumer Rights and interests Protection Law have begun to lag behind the times, and at present, the main rules for the protection of consumers' rights and interests in our country are stipulated in the Act. Other rules of protection are scattered among laws and regulations such as General principles of Civil Law, contract Law and Anti-unfair Competition Law, but in any case, these laws do not take into account the characteristics of online transactions. Special regulations are made for the protection of consumers' rights and interests in online transactions, which makes the scope of consumer protection narrow and extremely weak. There are similarities and differences between online transactions and traditional transactions. This paper starts with the analysis of the rights and interests of network consumers and combines the current situation of foreign e-commerce legislation with defining network consumers as the starting point. The author thinks that on the one hand, we should strengthen the protection of online trading consumers under the existing legal system, and on the other hand, we should establish a new legal system to protect the rights and interests of consumers. This article divides into four parts to carry on the discussion to the network transaction consumer rights and interests protection. The first part describes the rights and interests of the consumers in the network transaction, which lays the foundation for the author's later discussion. This part describes the concept, types and characteristics of the network transaction, and combines with the comparison of the consumers in the traditional transaction. Get the scope of the rights and interests that the consumer should have. The second part analyzes the existing protection system of consumers' rights and interests, and points out that the existing system is inadequate in two aspects, namely, the consumers' right to know and the protection of the right to fair trade. Therefore, it is necessary to provide for the information disclosure and format contract of the operator separately. In the third part, aiming at the imperfection of the existing legal system in our country, the author thinks that several new systems should be introduced to strengthen the legitimate rights and interests of the consumers in the network transaction, namely, the revocation right system and the jurisdiction system of the consumer's domicile litigation. These three systems are the introduction or modification of foreign institutions. Part 4th believes that the protection of consumers' rights and interests in online transactions should not only be limited to the protection of legislation and justice, but also use the network to protect the legitimate rights and interests of consumers through the characteristics of the network itself. Such as the use of the network to establish supervision agencies, complaints processing center, online dispute resolution mechanism, network credit evaluation mechanism.
