关于我国信用卡滞纳金问题的案例分析

【摘要】:随着经济的迅速发展,我国信用卡用户的数量迅速增加,信用卡市场的规模不断扩大。但随之而来,银行与信用卡用户之间的纠纷呈现迅速增长的趋势。虽然我国正加快关于信用卡方面的专项立法,但有关信用卡滞纳金的明确规定仍然仅存于1999年中国人民银行颁布的《银行卡业务管理办法》第二十二条:发卡银行对贷记卡持卡人未偿还最低还款额和超信用额度用卡的行为,应当分别按最低还款额未还部分、超过信用额度部分的5%收取滞纳金和超限费。随着纠纷的不断出现,其规定的不足之处日益凸显,信用卡滞纳金的规定被卡民称为“合法的抢劫”。本文将结合具体案例,从信用卡滞纳金相关理论入手,对其存在的问题进行分析,力求在平衡银行与信用卡客户利益的前提下寻找解决此问题的合理方法。 本文将结合具体案例从如下结构展开讨论: 第一部分,对欧陨与民生银行信用卡纠纷案进行简要的介绍并引出案件争议的焦点。当前我国银行信用卡滞纳金的收费标准是否合理;作为银行信用卡滞纳金收费依据的《银行卡业务管理办法》相关规定与《合同法》是否存在在实质上的冲突;以及信用卡滞纳金条款是否为霸王条款等问题。 第二部分,首先分析了信用卡滞纳金的由来,并通过信用卡滞纳金与传统行政法滞纳金的比较,对信用卡滞纳金进行定性分析,得出信用卡滞纳金实质上为合同违约金的性质。对我国现行信用卡滞纳金法律规制体系进行简要的分析。 第三部分,针对本案涉及的争议焦点及相关法律问题展开论述,就滞纳金收费标准问题;滞纳金条款与合同法规定的冲突问题;滞纳金条款是否为霸王条款等问题进行简要法律分析。 第四部分,从银行、法院、立法及消费者自身方面,对解决我国信用卡滞纳金问题提出合理化的建议,探索信用卡滞纳金纠纷的解决机制。
[Abstract]:With the rapid development of economy, the number of credit card users in China is increasing rapidly, and the scale of credit card market is expanding. Disputes between banks and credit card users are on the rise. Although China is speeding up special legislation on credit cards, However, the clear provisions on late payment of credit cards remain only in Article 22 of the "measures for the Administration of Bank Card Business" promulgated by the people's Bank of China in 1999: the minimum amount of outstanding repayment and the excess of credit by the issuing bank to the cardholders of the credit card. The behavior of the quota card, The outstanding portion of the minimum repayment amount should be charged separately, and 5% of the credit line should be charged for late fees and overrun fees. As disputes continue to arise, the deficiencies of its provisions become increasingly prominent. The regulation of credit card late fee is called "lawful robbery" by card people. This article will combine the specific case, start with the relevant theory of credit card late fee, and analyze its existing problems. In order to balance the interests of banks and credit card customers to find a reasonable solution to this problem. This article will discuss the following structure in the context of specific cases:. In the first part, the author briefly introduces the case of the credit card dispute between European meteorite and Minsheng Bank and leads to the focus of the dispute. As the basis of bank credit card late fee collection, the relevant regulations of bank card business management method and contract law are in conflict in essence, and whether the credit card late fee clause is overlord clause or not. In the second part, the origin of credit card late fee is analyzed, and through the comparison between credit card late fee and traditional administrative law late fee, the credit card late fee is qualitatively analyzed. The author draws the conclusion that credit card late payment is essentially the nature of contract breach of contract and briefly analyzes the current legal regulation system of credit card late payment in China. The third part discusses the focus of the dispute and related legal issues related to the case, on the issue of the standard of late fees, the conflict between the term of late payment and the contract law; Whether the late payment clause is the overlord clause and so on carries on the brief legal analysis. The fourth part, from the banks, courts, legislation and consumers themselves, to solve the problem of credit card late fees put forward reasonable suggestions, explore the settlement mechanism of credit card late fee disputes.
