论房屋承租人优先购买权的保护

【摘要】:房屋承租人的优先购买权是指房屋承租人在一定的条件下对其所租赁的房屋享有较之一般的购买人优先购买的权利。优先购买权在罗马法的时期业已存在,并经由《法国民法典》、《德国民法典》和《瑞士民法典》的继承和发展。我国《合同法》第230条、《最高人民法院关于审理城镇房屋租赁合同纠纷案件具体应用法律若干问题的解释》第21-24条等均对于房屋承租人的优先购买权做出了规定,但是从很多方面看,我国的法律仍有许多不完备的地方。尤其是在审判实践中仍有许多疏漏和不足的地方,法律对该问题的相关规定也不够完备,对若干重要问题也没有作出相应的规定,个别制度设计亦尚有值得探讨之处。 在现实经济交往中,由于房屋所有权人将已经出租的房屋出售给第三人而与承租人产生纠纷,或损害承租人优先购买权的案件时有发生。而在审判实践中由于对房屋承租人优先购买权的法律性质认识不一,导致对案件的实体处理不尽相同。本文试图结合现行的法律,,通过对承租人的优先购买权性质的法理探讨,并结合相关的实际案例进行分析,以期对审判实践有所裨益。

Especially there are still many omissions and deficiencies in the judicial practice, the relevant provisions of the legal issues is not complete, on a number of important issues do not make corresponding regulations, individual system design is also There is something worth discussing.
In the real economic exchanges, the owner of the house will be rental housing has been sold to third people and a dispute with the lessee, the lessee preemption or damage cases have occurred. But in judicial practice because of the legal nature of the lessee's preemption is not a recognized entity, to deal with the case is not the same. This paper tries to combine the existing law to explore the legal nature of the right to buy the lessee's priority, and combined with the actual case related analysis, in order to benefit the judicial practice.
