译作质量与立法意图——以《合同法》英译为例

【摘要】：法律翻译质量评估必须以一定的原则为标准,而其中最基本也是最高的标准即保证译文严格忠实于原文,即译文要体现原文的立法意图,实现法律效力的对等。文章先讨论了规范性法律文本的语言特点和翻译原则,紧接着阐述了法律翻译质量评估的标准。文章最后通过《合同法》两个英译本的比较,从词语选用、句法结构和语篇三个层次对译作质量和立法意图两者的关系进行了探讨。
[Abstract]:The quality evaluation of legal translation must be based on certain principles, and the most basic and highest standard is to ensure that the translation is strictly faithful to the original text, that is, the translation should embody the legislative intention of the original text and achieve the equivalence of legal effect. This paper first discusses the linguistic characteristics and translation principles of normative legal texts, and then expounds the criteria for evaluating the quality of legal translation. Finally, through the comparison of the two English versions of contract Law, this paper probes into the relationship between the quality of the translation and the legislative intention from the three levels of choice of words, syntactic structure and text.
