论虚拟财产权的民法保护

【摘要】：随着社会经济的飞速发展,网络走进了我们的生活。随之新兴起来的网络游戏大行其道,玩家在游戏的虚拟世界尽情享受游戏所带来的乐趣。因此,许多玩家为了提高自己在游戏中的人物等级,致使关于财产纠纷的案件逐渐增多。这些案件在现实中不能得到很好的解决,因为我国民法对虚拟财产的保护不到位。这体现在理论上争议较多,立法上不够准确明晰,到司法实践中法官更是会左右为难,可见对于虚拟财产的保护已经迫在眉睫。本文通过以下六个部分来对虚拟财产权的民法保护作简单而清晰的陈述。第一部分先对引言部分进行陈述。该部分从理论意义和实践意义上来研究该论题的背景并解决当前应当面对的问题,与此同时对有关对虚拟财产研究中所需要用到的文献做简洁的介绍。最后,对文章的行文结构的编排进行分析,对文章各部分所用到的研究方法也进行了分析论证。第二部分为虚拟财产权的性质和归属。这一部分首先讨论了虚拟财产物的属性,即虚拟财产是民法意义上的物;之后进一步论证了虚拟财产在性质上属于物权,应当纳入民法的保护范围;最后推出虚拟财产权应当归属于玩家。第三部分为虚拟财产权的物权保护。这一部分写了国外对虚拟财产进行保护的立法和对中国的借鉴意义,之后进行对比说明我国在虚拟财产权物权上保护的具体方法。第四部分为虚拟财产权的债权保护。这一部分侧重论述侵权法对虚拟财产的保护与合同法对虚拟财产的保护。其中,侵权法的保护主要侧重于写关于虚拟财产的侵权类型,数额认定,以及能否索要精神损害赔偿。关于合同法上的保护则侧重于写涉及虚拟财产的合同的成立、终止及履行,以及违约之后双方应承担的违约责任。第五部分为虚拟财产民法保护的立法模式完善。这一部分先写了虚拟财产在我国立法中所面临的问题,紧接着说明我国虚拟财产在立法上的必要性,最后结合上述问题提出了解决方案,即我国应当有针对性的对虚拟财产出台合理的司法解释。第六部分是结语。对全文内容进行了归纳总结,并针对理论以及现实的情况提出了一些建议,以期能对虚拟财产的保护做些贡献。
[Abstract]:With the rapid development of social economy, the network has come into our life. With the emergence of online games, players in the virtual world of the game to enjoy the fun of the game. As a result, many players in order to improve their level in the game, resulting in property disputes over the increasing number of cases. These cases can not be solved well in reality, because the protection of virtual property in civil law is not in place. This is reflected in the theoretical controversy, legislation is not accurate and clear, to the judicial practice, judges will be in a dilemma, so it is urgent to protect virtual property. In this paper, the following six parts to make a simple and clear statement of the civil law protection of virtual property rights. The first part of the introduction of the first part of the statement. In this part, the background of the thesis is studied from the theoretical and practical point of view, and the problems that should be faced are solved. At the same time, the literature needed in the study of virtual property is briefly introduced. Finally, the paper analyzes the layout of the structure of the article, and the research methods used in each part of the article are also analyzed and demonstrated. The second part is the nature and attribution of virtual property right. This part firstly discusses the attribute of virtual property, that is, virtual property is in the sense of civil law, and then further demonstrates that virtual property belongs to property right in nature and should be included in the protection scope of civil law. Finally, the introduction of virtual property rights should be attributed to the player. The third part is the real right protection of virtual property right. This part describes the foreign legislation on the protection of virtual property and the significance of reference to China, and then compares and explains the specific methods of real right protection of virtual property in our country. The fourth part is the protection of virtual property rights. This part focuses on the protection of virtual property in tort law and the protection of virtual property in contract law. Among them, the protection of tort law mainly focuses on writing about the type of infringement of virtual property, the determination of the amount, and whether to claim compensation for spiritual damage. The protection of contract law focuses on the formation, termination and performance of the contract involving virtual property, and the liability of both parties for breach of contract after breach of contract. The fifth part is the perfection of the legislative model of the civil law protection of virtual property. This part first writes about the problems of virtual property in the legislation of our country, then explains the necessity of the legislation of virtual property in our country, and finally puts forward a solution to the above problems. That is, our country should have a reasonable judicial interpretation of virtual property. The sixth part is the conclusion. This paper summarizes the content of this paper and puts forward some suggestions in view of the theory and reality in order to make some contributions to the protection of virtual property.
