我国劳务派遣法律规制研究

【摘要】:随着市场经济的深入发展,各种经济组织形式的出现,从而对用工形式的多样化提出了新的要求,劳务派遣在经济发展和劳动力市场需求的作用下,首先在西方发达资本主义国家出现并逐渐发展成熟,劳务派遣成为劳动力市场上各方都普遍关注的用工形式。 劳务派遣是这样一种用工形式即,派遣单位与派遣劳动者签订劳动合同,派遣单位与用工单位签订派遣协议约定派遣人员数量,派遣岗位,派遣时间和劳动报酬等相关内容,将劳动者派遣到用工单位,派遣的劳动者在用工单位的监督与管理之下从事劳动的一种特殊的用工形式。 劳务派遣以其灵活性,弹性等用工优点在西方国家已经发展进入了成熟的阶段,但劳务派遣打破了传统劳动关系的用工模式,传统的劳动关系是劳动者与雇主的一对一的关系,而劳务派遣使雇佣与用工相分离,雇佣不使用,使用不雇佣,形成了派遣单位,派遣劳动者与用工单位的三者之间的关系,使关系更加的复杂,经常出现劳动者权益受损害的现象,如何促进劳务派遣的健康发展,在理论和实务界一直存在着争议,从而推动了劳动法学的研究。 随着改革开放以来,劳务派遣在我国也得到了快速的发展,尤其是在沿海经济发达地区,存在着大量的劳务派遣,如何对劳务派遣进行规范的管理促进其健康的发展,一直也没有统一的相关规定,管理上也存在着混乱,这一状况直到2008年实施的新的《劳动合同法》得到了改善,新的《劳动合同法》首次对劳务派遣作了相关规定,使劳务派遣在我国正式得到了法律的认可,劳务派遣的发展从此有法可依,对劳务派遣在我国的发展具有促进作用。但是这是法律对劳务派遣的首次认可,在法律规制方面难免存在着一些不足,如何完善劳务派遣的法律规制,促进劳务派遣的健康发展,建立和谐的劳动关系,成为本文研究的目的。 本文以劳务派遣在发展过程中所涉及的法律问题为基本脉络,首先从我国劳务派遣发展的背景和现状,认为劳务派遣是在企业用工成本的控制,个人就业需求和市场对劳动力资源配置的共同作用之下逐渐发展起来的,从而呈现出劳务派遣在不同的地区,不同的职业范围和不同的就业人员之间的不同发展状况;其次从劳务派遣的市场运作状况分析了劳务派遣单位的经营地位和经营模式及派遣人员的数量和时间,通过对市场运作状况的分析,以期发现劳务派遣在市场运作中存在的问题,为法律规制指明规制的方向;然后对劳务派遣主体间的法律关系进行了界定,目前理论界存在着一重劳动关系学说和双重劳动关系学说的争论,通过分析本文认为目前我国的劳务派遣是一重劳动关系;再次分析了我国现行的法律对劳务派遣规制存在在不足之处,并通过介绍美国、德国和日本在劳务派遣方面的法律规制的经验,最后对完善我国劳务派遣法律规制提出建议以促进我国劳务派遣的健康发展和促进就业。
[Abstract]:With the in - depth development of market economy and the emergence of various kinds of economic organizations , new demands are put forward to the diversification of the forms of employment , and the dispatch of labor in the western developed capitalist countries has gradually developed and matured in the western developed capitalist countries .

Labor dispatching is a kind of labor form , namely , the dispatching unit signs the labor contract with the dispatched worker , the dispatching unit and the employing unit sign the relevant contents such as the number of dispatched personnel , the dispatching position , the dispatching time and the labor remuneration , etc . , and the dispatched workers are dispatched to the employing unit , and the dispatched workers are engaged in a special employment form under the supervision and management of the employing unit .

Labor dispatching , with its flexibility , flexibility and so on , has developed into a mature stage in western countries , but labor dispatch breaks the employment pattern of traditional labor relations . Traditional labor relations are the one - to - one relationship between workers and employers .

With the reform and opening - up , the dispatch of labor service has also been rapidly developed in our country , especially in the developed areas of the sea , there is a lot of labor dispatch , how to regulate the dispatch of labor service to promote its healthy development , there is also confusion in the management of labor dispatch . However , this is the first recognition of labor dispatch in China . However , this is the first recognition of labor dispatch in China . It is difficult to perfect the legal regulation of labor dispatch , promote the healthy development of labor dispatch , and establish harmonious labor relations , which is the purpose of this study .

Based on the background and present situation of the development of labor dispatch in China , the author believes that the dispatch of labor is gradually developed under the control of the cost of labor service , the demand of individual employment and the common role of market on the resource allocation of the labor force , so as to present the different development situation of labor dispatch in different areas , different occupation ranges and different employment personnel ;
Secondly , it analyzes the operating status and operating mode of the dispatching unit and the quantity and time of the dispatched personnel from the market operation status of the labor dispatching unit , through the analysis of the market operation status , in order to find out the problems existing in the market operation of the labor dispatching unit , and to specify the direction of regulation for the legal regulation ;
Then , the author defines the legal relations among the labor dispatch bodies , and there is a debate about the theory of labor relations and the theory of double labor relations in the theoretical circles . By analyzing the present paper , it is believed that the labor dispatch in China is a labor relation ;
This paper analyzes the existing laws and regulations of labor dispatch in our country , and puts forward some suggestions to improve the legal regulation of labor dispatch in America , Germany and Japan , so as to promote the healthy development of labor dispatch and promote employment in our country .
