【摘要】：随着现代高科技术产品电脑、IPAD、智能手机等的普及，移动通信服务业的发展突飞猛进，，各移动通信运营商们为了在市场竞争中取得优胜地位，实现企业利益的最大化，纷纷采取各种方式来提高交易效率、节约交易成本。移动通信用户基于移动通信运营商的垄断地位，又不得不接受者这些不公正、不合理的格式条款。这严重损害了原本就处于弱势地位的移动通信用户的合法权益。因而从法律方面深层次分析移动通信服务合同格式条款，以及如何有效规制问题格式条款，成为了现阶段法学理论界及法学实践中所面临的一个非常紧迫且意义重大的课题。本文从民法、合同法基本原理出发，根据我国现有的法律、法规，对移动通信服务合同格式条款进行研究。本文主要分为三大部分：第一部分为移动通信服务合同格式条款法理分析。第二部分为移动通信服务合同不公正格式条款法律分析。第三部分为移动通信服务合同格式条款规制并对如何有效规制移动通信服务合同格式条款提出了几点规制建议，以平衡移动通信运营商与移动通信用户之间的权利与义务，维护移动通信用户的权益，实现公平与正义。
[Abstract]:With the popularization of modern high-tech products such as IPAD and smart phones, the development of mobile communication service industry is advancing by leaps and bounds. In order to obtain the superior position in the market competition and realize the maximization of the enterprise benefit, One after another, various ways to improve the efficiency of transactions and save transaction costs. Based on the monopoly of mobile communication operators, mobile communication users have to accept these unfair and unreasonable format terms. This seriously damages the legitimate rights and interests of mobile communication users who are already in a weak position. Therefore, it has become a very urgent and significant topic to analyze the format clauses of mobile communication service contract from the legal aspect and how to regulate the problem format clauses effectively in the field of legal theory and practice. Based on the basic principles of civil law and contract law, according to the existing laws and regulations of our country, this paper studies the contract format clauses of mobile communication service. This paper is mainly divided into three parts: the first part is the legal analysis of the format clauses of mobile communication service contract. The second part is the legal analysis of unfair format clause of mobile communication service contract. The third part is about the regulation of the format clause of mobile communication service contract and puts forward some suggestions on how to regulate the format clause of mobile communication service contract effectively, in order to balance the rights and obligations between the mobile communication operator and the mobile communication user. Safeguard the rights and interests of mobile communication users and realize fairness and justice.
