鄂尔多斯市企业劳动争议多元调解机制构建研究

【摘要】:随着鄂尔多斯市经济社会的快速发展,劳动力市场的结构发生了很大的变化,劳资关系也变得越来越复杂,劳动争议案件也呈现出急剧上升的趋势。虽然国家已经陆续颁布了《劳动合同法》与《劳动争议调解仲裁法》,但是社会及民众对高效的劳动争议调解机制的需求日渐增多,劳动争议调解能力在一定程度上严重的影响到了鄂尔多斯市的社会和谐。 基于此,本文首先分析了劳动争议调解的内涵及其特征等相关理论知识;其次,对劳动争议多元调解机制的内涵、思路、原则、理念及一般模式进行深入的分析;再次,本文通过问卷调查的形式,从调解组织中日常参与调解工作的人员比例、一般劳动争议案件调解周期、劳动争议主体及其对一般性劳动争议的态度、调解困境、与其他单位合作调解的频率,以及鄂尔多斯市企业近三年来劳动争议案件数量及类型等七个方面,,分析了鄂尔多斯市现行的劳动争议调解机制存在的问题及原因;接着,本文首先采用SWOT分析法对鄂尔多斯市构建劳动争议多元调解机制的环境进行分析,确定该机制构建的目标,进而针对鄂尔多斯市的具体情况,以及多元调解机制的思想,从建立以企业内部调解委员会为中心、横向及纵向调解体系、调解网络关系的形成及制度建设、人才培养及激励制度、前期及后期控制和反馈机制的构建等多角度,提出劳动争议多元调解机制的构想;最后,本文就所提出的劳动争议多元调解机制影响因素进行分析与排序,确定最关键、最重要及一般的影响因素。
[Abstract]:With the rapid development of the economy and society in Ordos, the structure of labor market has changed greatly, the labor relations have become more and more complicated, and the labor dispute cases have been rising sharply. Although the state has promulgated the Labor contract Law and the Labor dispute Mediation and Arbitration Law one after another, the demand of the society and the public for an efficient labor dispute mediation mechanism is increasing day by day. The ability of labor dispute mediation has seriously affected the social harmony in Ordos to a certain extent. Based on this, this paper first analyzes the connotation and characteristics of labor dispute mediation and other relevant theoretical knowledge; secondly, the connotation, ideas, principles, concepts and general models of labor dispute mediation mechanism in-depth analysis; third, In this paper, through the form of questionnaire, from the mediation organization in the proportion of daily participation in mediation, general labor dispute cases mediation cycle, labor disputes and their attitude towards general labor disputes, mediation difficulties, The frequency of cooperation and mediation with other units, as well as the number and types of labor dispute cases of enterprises in Ordos city in the past three years, are analyzed in this paper, and the existing problems and reasons of the current labor dispute mediation mechanism in Ordos are analyzed. In this paper, SWOT analysis method is used to analyze the environment of the construction of multi-mediation mechanism of labor dispute in Ordos city, and the goal of the mechanism is determined, and then the concrete situation of Ordos city and the idea of multi-mediation mechanism are discussed. From the establishment of the internal mediation committee as the center, horizontal and vertical mediation system, the formation of mediation network relationship and system construction, talent training and incentive system, early and late control and feedback mechanism construction, and so on. Finally, this paper analyzes and sorts the influencing factors of the labor dispute mediation mechanism, and determines the most critical, most important and general influencing factors.
