论我国留置权效力范围的立法完善

【摘要】：作为一项法定担保物权的留置权,在我国《民法通则》、《担保法》、《合同法》中都对其有所规定,但还有诸多争议之处。随着我国市场经济的快速发展,留置权的设置还是不能充分发挥其法定担保物权的作用,很难适应社会经济发展的需要。尽管《中华人民共和国物权法》有一定的进步意义,弥补了法律某些方面的不足,但是还是存在着留置权效力范围过窄、效力救济不完善等问题,严重限制留置权效力的发挥。本文试从研究我国留置权的效力范围和存在的不足入手,通过比较研究,得出关于我国留置权效力范围立法完善的建议。第一部分主要研究留置权的性质对留置权效力范围的影响以及关于留置权效力范围的各种理论争论。第二部分主要研究我国留置权效力范围的立法现状及存在的问题。主要包括留置权适用范围与留置权效力范围的关系,留置权的效力范围是否包含非融通物,除了动产是否还应包括不动产,财产性权利,主债之外债务人其他财产可否进行留置,是否需要作出一些排除性规定,如人身属性财产,以及留置权效力的救济等方面存在的问题。第三部分主要对国外关于留置权效力范围的立法以及司法实践进行了研究。列举了大陆法系和英美法系在留置权效力范围上的不同规定。通过比较研究得出外国留置权效力范围的立法和实践对我国留置权效力范围制度的借鉴。第四部分,通过借鉴国外先进立法经验、吸取国外立法与实践中的不足,结合我国国情,从实际出发,提出了完善我国留置权效力范围立法的合理化建议。
[Abstract]:As a legal lien of security interest, it is stipulated in the General principles of Civil Law, the Law of Guaranty and the contract Law in China, but there are still many controversies. With the rapid development of market economy in our country, the establishment of lien is still unable to give full play to the role of legal security right, and it is difficult to meet the needs of social and economic development. Although the property Law of the people's Republic of China has some progressive significance and makes up for the deficiency of some aspects of the law, there are still some problems, such as too narrow scope of lien validity and imperfect remedy of validity, which seriously limit the exertion of lien validity. This paper begins with the study of the scope of the validity of lien in China and its shortcomings, and through comparative study, draws some suggestions on the legislative perfection of the scope of the validity of lien in our country. The first part mainly studies the influence of the nature of lien on the scope of lien validity and various theoretical arguments about the scope of lien validity. The second part mainly studies the current legislative situation and existing problems of the scope of lien validity in China. It mainly includes the relationship between the scope of application of lien and the scope of validity of lien, whether the scope of validity of lien includes non-financial objects, and whether real property and property rights should be included in addition to movable property. It is necessary to make some exclusionary provisions, such as personal property and relief of lien effect, whether other property of debtor other than main debt can be lien. The third part mainly studies the foreign legislation and judicial practice on the scope of lien validity. The different provisions of civil law system and common law system in the scope of lien validity are listed. Through the comparative study, the author draws a conclusion that the legislation and practice of foreign lien validity range can draw lessons from our country's lien validity scope system. The fourth part, through drawing lessons from the foreign advanced legislative experience, drawing on the foreign legislation and practice deficiencies, combined with the situation of our country, from the reality, put forward the reasonable suggestions to perfect the scope legislation of the validity of lien in our country.
