侵权责任与违约责任之竞合:《合同法》第122条质疑

【摘要】：正 合同当事人之间发生的违约行为同时构成侵权行为时,合同违约方应承担违约责任,同时作为加害人又应承担侵权责任,这就发生了责任竞合的问题。此时,当事人应当主张哪种责任呢?我国《合同法》第122条规定:因当事人一方的违约行为,侵害对方人身、财产权益的,受损害方有权选择依照本法要求
[Abstract]:When the breach of contract between the parties to the contract constitutes an act of infringement, the party in breach of contract should bear the liability for breach of contract, and at the same time, as the perpetrator of the contract, it should bear the liability of infringement, which leads to the problem of the concurrence of the responsibilities. At this point, what kind of responsibility should the parties claim? Article 122 of the contract Law of China stipulates that if a party infringes upon the other party's personal and property rights and interests as a result of a breach of contract by a party, the aggrieved party shall have the right to choose to meet the requirements of this Law.
