夫妻忠诚协议的法律分析

【摘要】：近年来,随着经济的快速发展,人们的婚姻家庭观念发生了较大的变化。越来越多的夫妻,为了维护婚姻关系的稳定和自身的权益,签署了夫妻忠诚协议。当前法律以立法的形式将“夫妻应当相互忠实”写入了法条,但对夫妻忠诚协议却没有明确的规定。关于夫妻忠诚协议的效力,无论是法学界还是司法实践中都存在较大的争议,导致各地法院在审理案件时,出现了同案却不同判的情形。因此,文章将通过对夫妻忠诚协议的全面分析,针对当前法律的局限性提出建议。文章对夫妻忠诚协议的分析分为四个部分:第一部分,通过对三个经典案例的分析,引出夫妻忠诚协议的争议焦点;第二部分,介绍了夫妻忠诚协议的含义、性质以及类型;第三部分,对夫妻忠诚协议的效力进行了法律分析;第四部分,分析了夫妻忠诚协议在立法和司法中的局限性,并将如何应对夫妻忠诚协议的缺陷,提出了司法解释和司法审理的建议。
[Abstract]:In recent years, with the rapid development of economy, people's concept of marriage and family has changed greatly. More and more couples, in order to maintain the stability of marriage and their own rights and interests, signed loyalty agreements. The current law contains "husband and wife shall be faithful to each other" in the form of legislation, but there is no clear stipulation on the agreement of marital loyalty. About the validity of the agreement of husband and wife loyalty, whether in the legal circles or in judicial practice, there are great disputes, which leads to the different judgments in the same case when the local courts try the cases. Therefore, through the comprehensive analysis of husband and wife loyalty agreement, the article puts forward some suggestions on the limitation of current law. The article is divided into four parts: the first part, through the analysis of three classic cases, draw the dispute focus of the agreement, the second part, introduced the meaning, nature and types of the agreement. In the third part, the validity of the agreement of husband and wife loyalty is analyzed. In the fourth part, the author analyzes the limitation of husband and wife loyalty agreement in legislation and judicature, and how to deal with the limitation of husband and wife loyalty agreement, and puts forward some suggestions of judicial interpretation and judicial trial.
